Robo-Signer Misdeeds May Help Homeowners

Lenders and their accomplices utilized hundreds of Robo-Signers to improperly execute millions of documents. These inappropriate and potentially criminal acts are helping some homeowners stay in their homes by voiding foreclosures and, in some cases, muddying ownership of mortgages. With modest effort and minimal expense, homeowners at risk of foreclosure can determine if a Robo-Signer executed any documents pertaining to their mortgage. Armed with this information, homeowners in all 50 states may be able to get courts to stop or even reverse foreclosure actions. 

In judicial foreclosure states, copies of pertinent documents are usually filed by lenders as part of the foreclosure court case. These are available from the court clerk, and are frequently attached to the Summons and Complaint which homeowners are served with when the foreclosure action is filed. Homeowners should check if Robo-Signers executed the Affadavits and Assignments. In non-judicial foreclosure states, Notices of Default are usually mailed to the homeowner shortly after filing. Homeowners should check for Robo-Signers on the Notice of Default as well as Assignments, which are available from the local County Recorder.

Once the documents are located, homeowners can reference the Alleged Robo-Signer directory below or search online by inputting the signers’ names follow by “Robo-Signer” to identify if there have been any allegations against the signers.

If homeowners get a match, they may be able to allege that the signer did not properly verify all of the information represented in the documents and did not have the capacity to sign the documents. As a result, the documents are defective and invalid. As the foreclosure action was based on these documents, the foreclosure action is also defective and invalid.

Judges are not typically giving homeowners their homes mortgage-free as a result of  violations. However, lenders may be required to restart the foreclosure process in a proper manner and prove ownership of the mortgages. This may create sufficient leverage for homeowners to receive a favorable loan modification, approval on an American Homeowner Preservation short sale, or other long-term remedy which keeps families in their homes.

    1. I have an affidavit of indebtedness with Dionne Bowie signature for GMAC, LLC (Title Authorized Officer) and notarized by a Tamika Scott from PA


    2. I;m also looking for her info. this is what I have found; her commission is in Philadelphia county, Pennsylvania. From what i can tell at this point, the only online access to public records/copy of bond with her sig; cost $750 per year for access. I still can't believee it so will be calling to confirm. She notarized a Sub of Trustee for Katrina Jordan who is a suspected robo-signer; she works for McDermott & Justice Rpt in Philadellphia commission ID: 1265573, just can seem to get to the county records at a reasonable price. Can we compare sigs on docs with her?

I have a "Corrective Assignment of Mortgage" dated October 27, 2011 from MERS to Bank of New York Mellon as Successor by Merger to The Bank of New York, as Trustee for Certificate holders of CWMBS, Inc. by Cecilia Rodriguez as MERS Asst Secty. Witnesses signed as Mercedes Judilla and Mary Ann Hierman. Both names stamped and signatures appear machine like. Notary was Darryl Brown (1812305)in Ventura, CA. CAM Document was prepared by Daniel C. Consuegra, Esquire Tampa, FL. Doc states purpose is for "correcting assignee name" from Bank of New York, as Trustee on behalf of Certificate holders of CWMBS, Inc. alternative loan trust 2004-2005 mortgage pass-thru certificates series 2004-2005, indicated in previous Assignment of Mortgage. This AM instrument dated October 4, 2010 was also prepared by Daniel C. Consuegra, Esquire Tampa, FL. Signed by Christopher J. Bossman, "Asst Secretary of MERS by Corporate Resolution". Notarized in Tampa, FL by Tammy Martinez DD885786. Bossman's name and title is "ink stamped", below his signature and again in the notary. Interestingly, discovered other AM's for 2 unrelated actions signed by Christopher J. Bossman. Same witnesses and notary. However, his title is indicated as "Manager of Business Relations" for MERS, acting solely as nominee for America's Wholesale Lender. Both dated 2 months earlier in July 2010 and prepared by Daniel S Consugra, Esquire, Tampa, FL Since learned BOSSMAN is an employee of the Daniel Consuegra law firm. He signs as a MERS officer without disclosing he is a Consuegra-firm employee. He signs to transfer mortgages to trusts represented by the Consuegra firm. He often signed Assignments to trusts many years after the closing date of the trust. http://www.scribd.com/doc/47314589/16/Bossman-Christopher I suspect the "Corrective Assignment of Mortgage" by Cecelia Rodriguez over 1 year later is to cover-up the AM misdeeds of Bossman and Daniel Consuegra.

  11. Hey Kurt, I've been on the hunt for these two individuals myself. Cecilia Rodriguez signed an assigment dated May 30, 2011 with an unattached Aknowledgment notorized by Daryl Brown on June 24, 2011. Mr. Brown's Notary license is registered to an address in Palmdale, Calif. You need to see if you can find anything in the L.A. obits because a former employee of BAC by the name of Cecilia Brown passed away on June 29, 2011 after a long battle with cancer. In my case, if this was the same women I doubt she was having anything notarized 5 days before she passed away. I'd like to compare signature with you on our documents to see if this is a case of robo-signing. Can't even read the sig on my doc. [email protected]
