Carbon monoxide law!

Here's what you need to know about that new carbon monoxide law:   It's called the Carbon Monoxide Poisoning Prevention Act of 2010.  It requires carbon monoxide detectors to be installed in every "dwelling unit intended for human occupancy."  The legislature modified the TDS and MHTDS to include a reference to carbon monoxide detector devices.  This is all the disclosure between principals that is required.  But you must read on to protect yourself!   The device is inexpensive and is a lot like a smoke detector. There are also combination units available.   Every owner of a "dwelling unit intended for human occupancy" must install an approved carbon monoxide (CO) device in each existing dwelling unit having a fossil fuel burning heater or appliance, fireplace, or an attached garage.  The applicable time periods are as follows:               (1)  For all existing single-family dwelling units on or before July 1, 2011.             (2)  For all other existing dwelling units on or before January 1, 2013.  (Cal. Health & Safety Code §17926)   Check the language that comes packaged with the detectors to determine how many should be installed.  Typically centrally located outside of each separate sleeping area in the immediate vicinity of bedrooms.   A violation of this law is an infraction punishable by a maximum fine of $200 for each offense.  However, a property owner must receive a 30-day notice to correct first.  Landlords must install the CO detectors as indicated in the timeframe above.  The CO device must be operable at the time the tenant takes possession.  However, the tenant has the responsibility of notifying the owner if the tenant becomes aware of a broken CO device.
