We are behind in our house payments and foreclosure unavoidable. We have been married 4 years, but I am not on the title to the property. If we file a survivorship deed, will I be able to file Chapter 13 to save the property? My husband's job will not permit him to file. I appreciate the information! I am not on the first mortgage (we weren't married then), but signed dower interest on the 2nd mortgage. I very much need advice.

Get a BK lawyer. This question is way to complex for anyone in a forum to answer adequately.

Having said that, foreclosure never has to be inevitable. Every distressed home-owner has the same three options.

1. Loan modification
2. Short Sale
3. Foreclosure (never the right answer)

Yeah it seems like you are giving up before you have used every option afforded to you. You need to talk to your bank first and see if you can work something out. To keep from even going the foreclosure route.
