Isn't it amazing how someone will come on here and ask for a whole bunch of money w/out saying anything about themselves, their company or their background and use the word
'guaranteed'

Boys, While I agree it is a poor choice for the first post on BP and should have made an introduction fr=irst, the word guaranteed was taken out of context.
Lenda stated that the rents were guaranteed for one year, not the investors return guaranteed. Many investors buy properties and teh sellers guarantee rents for a period as an incentive or inducment to purchase.

I have always been leary of that as the seller has to account for that expense and therefore is probably charging more for the investment. Not only that, the investment should be good enough to buy without any seller guarantees of rent.

Will the SEC does not want the word "guarantee" for anything whether it be for returns,rents,etc they frown upon that and people have gotten into trouble for it.

If her use of the word "guaranteed" was the only problem the SEC would ask for definition of what she meant by "guaranteed rents for a year".

But, there is so much more wrong with the public offering she made with this post, starting with it being a unregistered and very public offer to borrow money. And yes, the SEC and every state regulator does consider a mortgage to be a security.

I will admit to being brand new to this forum but I have been in various aspects of the commercial and residential lending industry for a number of years. I cannot understand why the SEC would be in the least concerned with someone coming to a public forum and asking for a mortgage or help with a loan. I am more than willing to learn and if you can point to something in the SEC regs that would indicate that is a problem I would love to see it. I can see where offering a mortgage for sale would potentially be a problem but not in the other direction. But again, I am always willing to learn.

can you clear something up.
from my reading of the post soem one has asked for a loan.
and they have said that their rental or repayments are quaranteed.
not a return as in a sale but a return as in they can cover there repayments.
am I correct that in the US market you are not allowed to post this.
so if I have a lease and it is a quarantee of income i can't post that if I am looking for a funder.
this is very unusual for me as this is not in my market.
quarantee of return yes I can understand that but if you are asking for something for borrowing I can't understand that as you need to know if the person has the capacity to cover a loan.
