I do not have access to a fax machine very much and/or easily.

However, can you sign, scan and send contracts and have them be valid if you include a phrase such as : The Parties agree that both facsimile and all other electronic copies of signatures to this Agreement shall be treated as original signatures, binding both the Assignee and Assignor to their respective rights and obligations under this Agreement to the same extent as if such signatures were original signatures.

This business seems to run on faxes. And most of the contracts I've seen have some similar provision. May be a stretch, but it seems to be acceptable.

Fax machines aren't expensive. Buying a cheap one at Office [Max|Depot] is a good investment. They usually have a answer mode. So you can turn answer off and share your normal line. When someone needs to send you a fax, you can have them call ahead and you switch the machine on.

I'll probably pick one up off of craigslist.

So no to the scanning being valid for signatures though.?

I just like scanning because I can then store everything electronically and its less papers physically passing through my hands.

Ive also looked into fax.com and efax.com, anyone use these?
I just like idea of being able to send a contract directly from my computer when im not in my office.

I use eFax, and I know people that use MyFax. They work fine. Documents come in as PDF files. If you set up your PDF right you can sign your documents from a scanned image of your signature that you use as a " stamp" .

Does speed things up nicely and keeps less clutter.

im also worried about the stamp thing in some of my documents if they are still considered if i will submit it in fax. (sorry im a newbie)

I have heard Efax is great. I use a machine that is a printer, scanner, copier and fax. Like the other guy said, I store alot as electronic files instead of printing them. So, I just run the offer through the machine and it stores it as a PDF file. I can email that file to them. Most people these days have an email account. If not, then the fax is the second choice.

We have no choice anymore but to use scanned/emailed documents, because it is now standard. If we insist on faxes in order to put them in our files, we are behind the tech curve and will lose business!

Fax signatures vary by state. Most real estate brokers can send a specific form that all parties sign to validate there signature on faxes if there is any question. You can probably find one online if you are unsure of your states laws. Realisticly, no deal is final until you get a check or the property and good faith laws will cover most issues with signature validity.
