Is it legal?
Yes but only if you know exactly what you can and can not do.
Viable and practical. Not really.
A few reasons why agents rare wholesale deals in the same way that investors mean when they say they are wholesalers.
1. It can be against the house rules. Most agents work under a broker and the broker gets to set the rules that every agent who operates under them must follow. Not laws but house rules.
2. You have to be very careful about representation. In most states the seller who is not a professional is allowed to make assumptions about an agent's role unless the agent clearly spells out what they will and will not do for the seller. In some senses, guilty until you disclose.
3. There can be rules or laws about net commissions. This is where an agent agrees to sell for a price and then anything above that they keep as their commission. Very similar to a wholesale deal other than maybe the agent does not agree to buy like an investor would do when they get the deal 'under contract'.
If you really want to wholesale why not try it for a while without a license. Having a license should not help much when it comes to what a wholesaler does. If you find it works then why get the license. If it does not work having a license will not change much.
Do people walk through mine fields without harm? It is possible but few live to tell about the last field their walked into.
You should learn how to shortsale too. Realtors that can shortsale are the realtors that will be making money for now and the near future at least.
when wholesaling as a realtor, be sure to have prospective buyers or sellers sign a " non-representation" agreement. this is ususally tagged onto any contracts as an addenda
A year or so ago, we had a speaker at one of our company meetings.
Not only was he a realtor that did this, but he sugguested it! He has been doing this since 1976 or so and explained to us all the information on doing it.
It can be legal , but you have to have ALL your bases covered.
