Lot's of fraud out there in the commercial arena.

Many of these companies are middle man trying to get fees before the lender performs.

I don't care if they closed 10 deals in the last 6 months. I care about MY DEAL closing.

No money is to be paid upfront.If appraisal is needed I will pay the appraiser directly.

No benefit of my cash will go to a company or be held until they perform and fund at closing.

With this one request you will weed out 90% of the fakers out there.If they can really do what they say they will do then they can pay at closing.

If they say they have to hold money because buyers don't follow through say you can have a separate attorney account where your attorney holds the money and if you don't perform have a provision where the funds are released to the lender.

If the lender keeps making up BS they are a fraud.

Good advice Joel. Although I know of a few honest lenders that require an upfront fee, their fees are reasonable based on the work they have to perform. Although I myself never collect a fee until the transaction closes (too much hassle if the transaction fails to close), I do believe that some of the upfront fees collected are legit.

Any fee asked for before funding should be backed up by disclosure of the specific expense incurred by the lender and/or broker. So if you are working through a lender based in Colorado and your property is in Texas, than a fee covering round trip air fare, hotel and per diem for this is quite reasonable. Other fees can be paid directly or itemized; appraisal fees, inspection fees, legal fees etc. I think on many of the large commercial borrowings some amount of up front fee is unavoidable.

To play in my arena, commercial loans up to $1 million, Texas only, the only upfront fee needed would be for appraisor, paid directly. however, to play in a larger arena, expect to pay upfront for due diligence, travel, processing, etc. If the loan does not go through, this is money lost. Think of it as an expense of doing business.

The other side of the coin, as Joel points out, is the scammers closing few if any loans and living off the collection of upfront fees. A thorough background check of every broker or lender you are considering dealing with is well worth the effort.
