I am moving out of my existing apartment. I am currently on a month to month lease. How much notice do I have to give 30 or 40 or 60 days?

What does your lease say? Usually the lease addresses what happens at the end of the lease. Typically, it converts to month-to-month and specifies the notice you have to give. If it doesn't, google for " landlord tenant law" with the name of your city, county, or state.
my lease was up in June and since then it converted to a month to month lease. He was supposed to bring another lease to sign but never did.
This should have been addressed in the lease that ended in June. Check it. Usually, a lease reverts to month to month if not renewed.
If the lease doesn't say, then you're governed by local law.
On a month to month lease you have to give at least A MONTH's notice. If you want to move out the end of May you MUST give notice before May 1st. If you give notice on May 2nd you COULD be held liable for June's rent too.
all cash
In almost every state (except for about 3 of them), you must give a notice of a full rental period.
That means if the rent is due on the first and you give 30 day notice on the 10th, your 30 days don't start their count down until the first of the next month. So you owe the rest of the current month and all the next month.
You need to check your lease, because the terms may be different, as you agreed to by signing your lease.
If your rent is due on the first, be sure that notice is in the landlord's hand on the first (not in the mail on the first, it doesn't start the countdown until it is in the landlord's hand, and if he doesn't get it until the 4th, you owe all that month and all the next month.
ok thanks! My rent is due on the 25th so I think I will give it to him on the 20th that should be ok.
From a landlord's standpoint, please give a minimum of 30-days notice. It takes time to post ads for new renters, handle emails/phone calls and find a good replacement. The more notice I receive, the more time I have to find someone to rent your unit. I guess you don't have any obligation other than the 30-days, but I figure if I can be nice to someone and it doesn't hurt me - then why not?
