Is there any way to stop or postpone trustee sale auction date posted on 01/07/09?
House is located in CA.
Any suggestions? Thank you...

This house is only 20 days from shedulled auction date and property is in CA and I don't do it there.
I know to file for bancruptcy can stop it and postpone the sale as well.
Then file a case witha lawyer for forensic audit is another option what I know but I always looking for a new possible options.
I started with short sales, but I get (for now) only houses in pre foreclosure where usually only NOD/LP was recorded.
As soon as auction date is set and is so close to that day you need more challenging options to use and I looking for some new ones to use.

Jozef,
There is a way to keep the homeowners in their home for 6 months to a year ...AFTER the trustee sale. But its used only to buy them time to save money, etc...or if anything allow them to leave the property with dignity. I can help with it if you have someone.

The best way to begin the process of determining if you stop your sale date on Jan. 9th, Is to talk to a Real Estate Attorney in your area. An Attorney can provide you with the best options after evaluating your situation. You could qualify for a restructured loan if you have income that can meet the HAMP guidelines. The Attorney can crunch the numbers and determine if you would be a candidate for that program. If you do not have enough income then other options are possible as well. Other options consists consist of Deed in Lieu of Foreclosure, Cash for Keys, or consider to short-sale. There are many issue right now (you can see it in the news) about how the banks have processed there Foreclosure Documents. An Attorney can have a Mortgage Document Analysis produced and that could yield some potentially very intriguing results showing such things as Robo-Signing, Back-Dated assignments of the Deed of Trust, Potential issues with The Declaration of Compliance. Fraudulent Affidavits and so on.......
