It seems to me that a few people who responded in the first place misread your towing post.

For those who don't know, MANY ccrs have a section that says something like, "Just cuz we haven't enforced (this) rule before, against you or anyone else, doesn't mean we can't enforce it against just you." It's called SELECTIVE ENFORCEMENT and it happens frequently, and few "owners" can do anything about it, because if they resist, they become targets. I set the word "owners" in quotes, because members of hoas will never own their house--their share--of the corporation. There will always be a lien against it. So they really are not owners.
The rules are set to benefit the corporation, NOT individual owners.
It may be that all of the owners that have fences that need repair got notices, but no one else is 'fessing up to it. Unless they tell you they got notices, you have no real way of knowing.

Remember you are one vote away from catastrophe in an hoa.
The only people the hoa helps are lawyers and management company people. All the rules are already enforceable via city, county or state code.

When you managed those places, did you go round and check the neighbors' (fences) to see if others needed a note, too?
The very name HOMEOWNER ASSOCIATION is a lie and misleading. There are no owners, only share holders, and those shareholders did not set up the association, the developers did and called it that because few people would buy a share if they realized they would never completely, freely, own it.
