So as you&#8217;ll see, there are many sides to this discussion.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">A Rule of Thumb: Invest Where You Can Evict Quickly<\/span><\/h2>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/what-is-a-landlord\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Landlording<\/span><\/a><span data-preserver-spaces=\"true\"> is a business. <\/span><span data-preserver-spaces=\"true\">You need to correct<\/span><span data-preserver-spaces=\"true\"> it when your business stops producing revenue. The longer it takes to evict a tenant, the longer your business will suffer.&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">That&#8217;s why I advise any new investor or someone with limited resources to choose a landlord-friendly state where the eviction process is fast and relatively painless. <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/landlord-friendly-states\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">This article<\/span><\/a><span data-preserver-spaces=\"true\"> is a great <\/span><span data-preserver-spaces=\"true\">deep<\/span><span data-preserver-spaces=\"true\"> dive into the top landlord-friendly states and why they are good places to invest.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Other considerations, such as taxes and rent increase restrictions, also make a state welcoming to landlords.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Why It Is So Hard to Turn a Profit in Tenant-Friendly States<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">When <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.nyc.gov\/site\/specialenforcement\/registration-law\/registration.page\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Local Law 18<\/span><\/a> <span data-preserver-spaces=\"true\">was enacted<\/span><span data-preserver-spaces=\"true\"> in New York City, and Airbnb was outlawed, many would-be landlords were reluctant to rent to yearly tenants. However, &#8220;the working-class homeowner who was maybe renting out a place for $99 a night and needs the money has been the hardest hit,&#8221; contractor and filmmaker Tony Lindsay, who has a house in Bushwick, Brooklyn, told the<\/span> <em><a class=\"editor-rtfLink\" href=\"https:\/\/www.nytimes.com\/2024\/02\/09\/nyregion\/nyc-airbnb-rentals.html\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">New York Times<\/span><\/a><\/em><span data-preserver-spaces=\"true\">. &#8220;We&#8217;re not getting rich off this.&#8221;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">The <\/span><em><span data-preserver-spaces=\"true\">Times <\/span><\/em><span data-preserver-spaces=\"true\">article went on to say:&nbsp;<\/span><\/p>\n\n\n\n<p><em><span data-preserver-spaces=\"true\">Every Airbnb host I spoke with seemed to know a story about a <\/span><span data-preserver-spaces=\"true\">difficult<\/span><span data-preserver-spaces=\"true\"> tenant who became impossible to remove. Mr. Lindsay said that his father&#8217;s tenants in Bushwick stopped paying rent during the coronavirus pandemic. <\/span><span data-preserver-spaces=\"true\">He eventually served them <\/span><span data-preserver-spaces=\"true\">with<\/span><span data-preserver-spaces=\"true\"> eviction notices, but the tenants <\/span><span data-preserver-spaces=\"true\">are still there<\/span><span data-preserver-spaces=\"true\">.<\/span><\/em><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Small-time landlords who depend on rental income to survive suffer the most when tenants don&#8217;t pay. Affluent landlords with generational wealth, low mortgages, and multiple higher-end buildings to offset losses might better weather the storm.&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">As a former Brooklyn property owner, I was fortunate. I owned a brownstone for two decades and never had <\/span><span data-preserver-spaces=\"true\">any<\/span><span data-preserver-spaces=\"true\"> issues with nonpaying tenants. I <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/how-to-screen-tenants\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">screened thoroughly<\/span><\/a><span data-preserver-spaces=\"true\">, rented to tenants with good jobs, and charged slightly below market rent. As the home appreciated, I realized that while I wouldn&#8217;t get rich on rent, simply holding on to the property and enjoying depreciation and appreciation was the winning strategy.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">How to Protect Yourself<\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Have a rock-solid lease&nbsp;<\/span><\/h3>\n\n\n\n<p><span data-preserver-spaces=\"true\">If you <\/span><span data-preserver-spaces=\"true\">are using<\/span><span data-preserver-spaces=\"true\"> a generic rental lease you found online and not one specific to your state <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/dont-use-free-lease-templates\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">vetted by a lawyer<\/span><\/a><span data-preserver-spaces=\"true\">, you could be setting yourself up for problems. A legally binding lease specific to your state is essential when evicting a tenant. It won&#8217;t miraculously change the laws in your state to result in a condensed eviction process, especially if your tenant has legal representation, but it could prevent lengthening it.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Run a background check and screen <\/span><span data-preserver-spaces=\"true\">scrupulously<\/span><\/h3>\n\n\n\n<p><span data-preserver-spaces=\"true\">You&#8217;ll be amazed when seemingly upstanding citizens with good jobs and impeccable backgrounds intend to defraud you of rent payments and know every legal loophole in the book to keep them in your apartment rent-free. Professional tenants in tenant-friendly states know the system better than many attorneys. The best\/worst professional tenants are often the smoothest talking.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Horror stories such as one in the<\/span> <em><a class=\"editor-rtfLink\" href=\"https:\/\/www.nytimes.com\/2004\/12\/19\/realestate\/a-landlords-worst-nightmare.html\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">New York Times<\/span><\/a><\/em><span data-preserver-spaces=\"true\">, in which an unsuspecting landlord was left $100,000 in the hole by a master con man in New York City, are scenarios all would-be landlords should heed. It&#8217;s worth spending the money for a thorough background check before letting any tenant into your dwelling.&nbsp;&nbsp;<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Don&#8217;t invest in bad neighborhoods\u2014in any <\/span><span data-preserver-spaces=\"true\">state<\/span><\/h3>\n\n\n\n<p><span data-preserver-spaces=\"true\">Having owned multiple apartments in Newark, New Jersey, generally a landlord-friendly state, as a newbie investor, I was continually in landlord-tenant court, evicting tenants who were quick to call Legal Aid as soon as they received an eviction notice, fabricating excuses that were hard to disprove without spending money on a lawyer. While my eviction times could have been longer if I <\/span><span data-preserver-spaces=\"true\">was<\/span><span data-preserver-spaces=\"true\"> across the Hudson in New York, it was still torturous, stressful, and financially crippling, causing me to divest all of my units and vow never to make the same mistake again.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Regardless of your state&#8217;s landlord-tenant laws, there are good, honest, on-time paying tenants in every state. Your job as a landlord is to find them by providing quality accommodation and thoroughly screening them.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Consider squatters rights<\/span><\/h3>\n\n\n\n<p><span data-preserver-spaces=\"true\">After<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/abc7ny.com\/squatters-squatting-rent-homeowner\/14553934\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> a video<\/span><\/a><span data-preserver-spaces=\"true\"> surfaced of a Queens, New York, landlord <\/span><span data-preserver-spaces=\"true\">being arrested<\/span><span data-preserver-spaces=\"true\"> for trying to change the locks on her squatter-inhabited home, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/how-a-squatter-in-oregon-was-paid-to-leave-home-he-was-not-renting\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">squatters rights<\/span><\/a><span data-preserver-spaces=\"true\"> have been a hot topic. Until recently, in New York, a <\/span><span data-preserver-spaces=\"true\">squatter<\/span><span data-preserver-spaces=\"true\"> could not be removed by the police for trespassing. Their eviction had to go through the legal system. According to ABC News, the average eviction in the city takes about two years to complete.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">&#8220;People can stay in homes for years, years, without having justice brought to them for essentially staying for free and making homeowners pay the bill,&#8221; NY State Assemblyman Jake Blumencranz, a Republican representing District 15, told <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/abc7ny.com\/squatters-squatting-rent-homeowner\/14553934\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Channel 7, Eyewitness News<\/span><\/a><span data-preserver-spaces=\"true\">. He filed a bill <\/span><span data-preserver-spaces=\"true\">that was<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.fox5ny.com\/news\/new-york-new-squatter-laws#\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> recently signed into law<\/span><\/a><span data-preserver-spaces=\"true\"> by New York Governor Kathy Hochul, which excluded squatters from tenant protection.&nbsp;&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">With a<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.cnn.com\/2024\/03\/02\/economy\/american-dream-cost-of-living-housing-childcare\/index.html\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> cost of living crisis<\/span><\/a><span data-preserver-spaces=\"true\"> sweeping the nation and homelessness a big issue, squatting has become more prevalent. Any landlord should check their<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/worldpopulationreview.com\/state-rankings\/squatters-rights-by-state\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> state&#8217;s squatter rights laws<\/span><\/a><span data-preserver-spaces=\"true\"> and ensure they take appropriate measures before leaving a home empty.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Short-Term Rentals: A Game Changer<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">As seen in New York City, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/guides\/the-ultimate-guide-to-short-term-rental-properties\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">short-term rentals<\/span><\/a><span data-preserver-spaces=\"true\"> were a game changer for landlords, exasperated by the tenant eviction process. For <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.extraspace.com\/blog\/moving\/buying-selling-renting\/best-cities-in-america-for-investing-in-airbnb\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Airbnb-friendly cities<\/span><\/a><span data-preserver-spaces=\"true\">, where laws favor tenants, short-term rentals allow landlords to skirt the hassles of adhering to long-term state-mandated rental agreements and laws. Instead, landlords are paid upfront for their space, and guests leave after a few days or weeks.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Sticking points <\/span><span data-preserver-spaces=\"true\">could<\/span><span data-preserver-spaces=\"true\"> arise if you have a mid-term lease for a month or longer.<\/span> <span data-preserver-spaces=\"true\">You <\/span><span data-preserver-spaces=\"true\">will need to<\/span><span data-preserver-spaces=\"true\"> check your<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.hud.gov\/topics\/rental_assistance\/tenantrights\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> local landlord-tenant laws<\/span><\/a><span data-preserver-spaces=\"true\"> and consult an attorney to ensure that a mid-term tenant <\/span><span data-preserver-spaces=\"true\">doesn&#8217;t outstay<\/span><span data-preserver-spaces=\"true\"> their welcome <\/span><span data-preserver-spaces=\"true\">or<\/span><span data-preserver-spaces=\"true\"> rent.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Final Thoughts<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">Real estate investing is fraught with potential risks. As a landlord, you must mitigate as many problems as possible. The easiest way to accomplish this is by buying an investment for cash. It might bring you peace of mind, which is priceless, but it would contradict most gurus&#8217; advice about the power of leverage.&nbsp;&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">So, assuming you have a mortgage with the lowest rate possible, purchased in a decent neighborhood, meticulously screened your tenants, and provided them with a state-specific lease, one of the remaining things that could trip you up is a loss of rental income to cover your expenses. It doesn&#8217;t necessarily mean that your tenant turned out to be <\/span><span data-preserver-spaces=\"true\">a Jekyll<\/span><span data-preserver-spaces=\"true\"> and Hyde character, intent on not paying rent when they moved in. People lose jobs, go through divorces, and have unforeseen medical expenses.&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">As a landlord, you want to stop the bleeding as soon as rent is a few days late.
