{"id":175072,"date":"2024-07-08T14:42:09","date_gmt":"2024-07-08T20:42:09","guid":{"rendered":"https:\/\/www.biggerpockets.com\/blog\/?p=175072"},"modified":"2024-08-04T21:47:28","modified_gmt":"2024-08-05T03:47:28","slug":"revisions-to-florida-live-local-act-take-opportunities-from-developers","status":"publish","type":"post","link":"https:\/\/www.biggerpockets.com\/blog\/revisions-to-florida-live-local-act-take-opportunities-from-developers","title":{"rendered":"A Revised Affordable Housing Law In Florida Takes Opportunities Away From Developers"},"content":{"rendered":"\n\n      <iframe loading=\"lazy\" frameborder=\"0\" height=\"200\" scrolling=\"no\" src=\"https:\/\/playlist.megaphone.fm\/?e=BIGPOC3464327992\" width=\"100%\"><\/iframe>\r\n  \n\n\n\n\n<p><span data-preserver-spaces=\"true\">Since first being introduced in 2023, Florida\u2019s Live Local Act\u2014the $711 million package offering developers tax breaks and bypassing local zoning restrictions to create more affordable and workforce housing\u2014has been a lightning rod for controversy. Local municipalities and residents argued that the increased height of buildings would ruin the character of neighborhoods and that the affordable housing component could cause residents to head to the suburbs.&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Not surprisingly, it is back in the headlines. Florida Governor<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/floridaphoenix.com\/2024\/06\/11\/report-revision-to-live-local-act-reduces-stock-of-affordable-workforce-housing-in-fl\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> Ron DeSantis recently signed <\/span><span data-preserver-spaces=\"true\">bill<\/span><span data-preserver-spaces=\"true\"> SB 328<\/span><\/a><span data-preserver-spaces=\"true\">, revising the original Local Live bill. The original bill gave tax breaks to developers who create <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/finding-multifamily-properties\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">multifamily<\/span><\/a><span data-preserver-spaces=\"true\"> and mixed-use residential properties with at least 70 units in any area zoned for commercial, industrial, or mixed-use. At least 40% of those units had to <\/span><span data-preserver-spaces=\"true\">be set aside<\/span><span data-preserver-spaces=\"true\"> for affordable housing\u2014defined as people making 120% of the local area median income (AMI)\u2014and would be enforceable for up to 30 years.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">The revised bill provides height restrictions for single-family neighborhoods and prohibits Live Local Act projects within airport flight paths, noise zones, and those that exceed airport height restrictions. It also allows counties to opt out of giving property tax exemptions to developers if the number of available, affordable units in a metro area is greater than the number of renter households that meet the income criteria for the 80% to 120% AMI amongst a raft of other clarifications, aimed at to ease uncertainties.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">But<\/span><span data-preserver-spaces=\"true\"> with the new revisions, some projects already undergoing the initial groundwork stages have been outright killed.<\/span> <span data-preserver-spaces=\"true\">Since the bill <\/span><span data-preserver-spaces=\"true\">specifically targets<\/span><span data-preserver-spaces=\"true\"> Florida\u2019s most dense areas, including <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/markets?market=Jacksonville%2C%20FL\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Jacksonville<\/span><\/a><span data-preserver-spaces=\"true\">, South Florida, Sarasota\/Bradenton, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/markets?market=Orlando-Kissimmee-Sanford%2C%20FL\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Orlando-Kissimmee<\/span><\/a><span data-preserver-spaces=\"true\">, and the <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/markets?market=Tampa-St.%20Petersburg-Clearwater%2C%20FL\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Tampa Bay area<\/span><\/a><span data-preserver-spaces=\"true\">, the backlash has been fierce<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\">&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Local Governments Angry Over Local Live&nbsp;<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\"> DeBary Mayor Karen Chasez said via email to the<\/span><em> <a class=\"editor-rtfLink\" href=\"https:\/\/www.news-journalonline.com\/story\/news\/2023\/05\/05\/how-floridas-live-local-act-will-affect-process-for-proposed-developments\/70185198007\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Daytona Beach News-Journal<\/span><\/a><\/em><span data-preserver-spaces=\"true\">:<\/span><\/p>\n\n\n\n<p><em><span data-preserver-spaces=\"true\">\u201cThe Live Local Act is regrettable, in my opinion, because it undercuts the kind of planning for &#8216;what goes where&#8217; in our cities that our residents rightfully expect we will define through our future land use maps and development codes. When we define areas as appropriate for industrial or commercial use, it is a thoughtful process. Live Local Act will allow those property owners to place apartments on any of those sites. <\/span><span data-preserver-spaces=\"true\">There are<\/span><span data-preserver-spaces=\"true\"> transportation, infrastructure, schools, and more <\/span><span data-preserver-spaces=\"true\">that<\/span><span data-preserver-spaces=\"true\"> must be available for residential development but not necessarily <\/span><span data-preserver-spaces=\"true\">so<\/span><span data-preserver-spaces=\"true\"> for commercial or industrial.&#8221;<\/span> <\/em><span data-preserver-spaces=\"true\">&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Developers and Municipalities Divided Over Local Live<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">The original Local Live bill <\/span><span data-preserver-spaces=\"true\">was intended<\/span><span data-preserver-spaces=\"true\"> to increase the number of housing units in some of Florida\u2019s densest cities and thus increase affordability for residents who were getting priced out. That created pushback from local governments, which started to delay the processing of development approvals.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Landlords and developers have butted heads with local municipalities, allegedly delaying approving projects using tax breaks under the new law. After the upscale<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.balharbourshops.com\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> Bal Harbour Shops<\/span><\/a><span data-preserver-spaces=\"true\"> owner announced a multimillion-dollar mixed-use expansion that includes a 17-story boutique hotel and 600 residential units, the Village of Bal Harbour put the brakes on. Local officials instructed the municipal attorney to investigate the possibility of a development moratorium.<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.costar.com\/article\/1894266372\/floridas-live-local-act-sparks-new-development-while-concerns-fuel-proposed-changes\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">&nbsp;<\/span><\/a><\/p>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/www.costar.com\/article\/1894266372\/floridas-live-local-act-sparks-new-development-while-concerns-fuel-proposed-changes\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">The developer retaliated<\/span><\/a><span data-preserver-spaces=\"true\"> by filing a lawsuit against the city, asking the Florida Circuit Court to force the city\u2019s approval of the project. The 161-page complaint alleged that the municipality created new restrictions to prevent the development from moving forward, highlighting a city memo that said building workforce housing would risk the city&#8217;s \u201cstanding as a unique and elegant community\u201d and its \u201crole as a luxury destination,\u201d as well as the safety and security of residents and the neighborhood.&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">The revised bill signed by Governor DeSantis in May provides height restrictions for single-family neighborhoods <\/span><span data-preserver-spaces=\"true\">and prohibits<\/span><span data-preserver-spaces=\"true\"> Live Local Act projects within airport flight paths, noise zones, and those that exceed airport height restrictions. It also allows counties to opt out of giving property tax exemptions to developers if the number of available, affordable units in a metro area is greater than the number of renter households that meet the income criteria for the 80% to 120% AMI amongst a raft of other clarifications, aimed at to ease uncertainties.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">What Local Live\u2019s Amendments Mean for Developers and Residents<\/span><\/h2>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/landtech.us\/blog\/the-importance-of-demographics-data-for-real-estate-developers-in-florida\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">LandTech<\/span><\/a><span data-preserver-spaces=\"true\">, a site sourcing technology and <\/span><span data-preserver-spaces=\"true\">data for developers<\/span><span data-preserver-spaces=\"true\">, crunched numbers on what the DeSantis amendments mean in real terms for developers. They came up with the following conclusions:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span data-preserver-spaces=\"true\">A <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/floridaphoenix.com\/2024\/06\/11\/report-revision-to-live-local-act-reduces-stock-of-affordable-workforce-housing-in-fl\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">22% reduction<\/span><\/a><span data-preserver-spaces=\"true\"> in sites available to affordable housing developers from what <\/span><span data-preserver-spaces=\"true\">was <\/span><span data-preserver-spaces=\"true\">originally<\/span><span data-preserver-spaces=\"true\"> proposed<\/span><span data-preserver-spaces=\"true\"> in Florida\u2019s five densest metropolitan areas.<\/span><\/li>\n\n\n\n<li><span data-preserver-spaces=\"true\">6.6 billion fewer square feet of land available for this kind of development than the 30.2 billion <\/span><span data-preserver-spaces=\"true\">that had been<\/span><span data-preserver-spaces=\"true\"> available under the original legislation.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span data-preserver-spaces=\"true\">\u201cWe\u2019ve had at least half a dozen affordable housing projects just die on the vine because of these new restrictions of using it, I would say, in the vicinity of airports,\u201d <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/floridaphoenix.com\/2024\/06\/11\/report-revision-to-live-local-act-reduces-stock-of-affordable-workforce-housing-in-fl\/#:~:text=%E2%80%9CWe&#039;ve%20had%20at%20least,of%20airports%2C%E2%80%9D%20says%20Cremer.\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">said Jake Cremer,<\/span><\/a><span data-preserver-spaces=\"true\"> a partner with Stearns Weaver Miller, a law firm with offices throughout Florida, in an interview with the <\/span><em><span data-preserver-spaces=\"true\">Florida Phoenix<\/span><\/em><span data-preserver-spaces=\"true\">.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Cremer\u2019s colleague Nicole Neugebauer MacInnes expounded: \u201cWhen you extend that runway out, you\u2019re taking a chunk of downtown Tampa, which takes those properties out of being eligible for Live Local. And we\u2019re seeing that all over the state because of the way that [the law] is written as it applies to airports. It doesn\u2019t say, \u2018large, commercial, Tampa International-style airports,\u2019 or these little, small-plane ones. It just says airports.\u201d<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Concessions to Developers<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">The amendment did not change the law that angered many municipalities, giving developers tax breaks to build on <\/span><span data-preserver-spaces=\"true\">land that was previously zoned industrial<\/span><span data-preserver-spaces=\"true\">.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">\u201cThe fact that we could still see one of these buildings go up in an industrial area where we normally wouldn\u2019t allow residential is <\/span><span data-preserver-spaces=\"true\">definitely<\/span><span data-preserver-spaces=\"true\"> concerning,\u201d <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/floridaphoenix.com\/2024\/06\/11\/report-revision-to-live-local-act-reduces-stock-of-affordable-workforce-housing-in-fl\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Doral Mayor Christi Fraga told the Florida Phoenix<\/span><\/a><span data-preserver-spaces=\"true\">. \u201cThe fact that the local authorities have zero say over that? I think that is a concern.\u201d&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Potential Loopholes are Cause for Concern Amongst Municipalities<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">One issue that the Local Live bill has attempted to address is the same facing many <\/span><span data-preserver-spaces=\"true\">major<\/span><span data-preserver-spaces=\"true\"> cities: the need for workforce housing. Workforce housing <\/span><span data-preserver-spaces=\"true\">is intended<\/span><span data-preserver-spaces=\"true\"> to be affordable to essential city workers, including law enforcement, teachers, and government employees. However, maintaining oversight over who drops in and out of the workforce criteria over <\/span><span data-preserver-spaces=\"true\">a 30-year period<\/span><span data-preserver-spaces=\"true\"> is, according to many, an almost impossible task, exposing the rule to abuse.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">\u201cThe onus on the auditing on whether 40% of the units are actually <\/span><span data-preserver-spaces=\"true\">being rented<\/span><span data-preserver-spaces=\"true\"> to workforce housing is <\/span><span data-preserver-spaces=\"true\">basically<\/span><span data-preserver-spaces=\"true\"> just an affidavit,\u201d Christi Fraga told the <\/span><em><span data-preserver-spaces=\"true\">Florida Phoenix<\/span><\/em><span data-preserver-spaces=\"true\">. \u201cI don\u2019t think that there\u2019s enough oversight or enforcement on that aspect, and really, all of that responsibility is being put on the city.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Recent Study Finds Out Florida Housing <\/span><span data-preserver-spaces=\"true\">Is Overvalued<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">A <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/finance.yahoo.com\/news\/study-finding-south-florida-homes-205626451.html\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">recent study<\/span><\/a><span data-preserver-spaces=\"true\"> from Florida Atlantic University and Florida International University found that the South Florida market is almost 35% overvalued, indicating that the area could be in a housing bubble.&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">\u201cThis trend does concern me, as prices are still going up in the Miami metropolitan area, but not in the rest of the measured areas in Florida,\u201d Ken H. Johnson, a real estate economist with FAU\u2019s College of Business, said in a statement.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Another <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.yahoo.com\/news\/sounds-study-says-fl-minimum-031500132.html\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">new report<\/span><\/a><span data-preserver-spaces=\"true\"> from the <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/nlihc.org\/oor\/state\/fl\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">National Low Income Housing Commission<\/span><\/a><span data-preserver-spaces=\"true\"> found that the average person working minimum wage in Florida has to work around 100 hours per week to afford a one-bedroom house in the state.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Despite the discrepancy between what people earn and what they can afford, research from<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/finance.yahoo.com\/news\/dave-ramsey-florida-housing-market-120008670.html\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> Dave Ramsey Solutions<\/span><\/a><span data-preserver-spaces=\"true\"> found that a market crash is unlikely. The state of Florida differs markedly from area to area. <\/span><span data-preserver-spaces=\"true\">House prices <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/floridas-gulf-coast-homeowners-are-slashing-prices-according-to-report\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">have fallen in West Florida<\/span><\/a><span data-preserver-spaces=\"true\"> due to increased construction<\/span><span data-preserver-spaces=\"true\">, <\/span><span data-preserver-spaces=\"true\">but <\/span><span data-preserver-spaces=\"true\">they<\/span><span data-preserver-spaces=\"true\"> have risen in other <\/span><span data-preserver-spaces=\"true\">areas<\/span><span data-preserver-spaces=\"true\"> due to low inventory.<\/span> <a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/luxury-homes-reach-highest-prices-yet-as-investors-look-for-deals\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Luxury real estate<\/span><\/a><span data-preserver-spaces=\"true\">\u2014such as new condos\u2014is out of reach financially for working-class Floridians, with a dire need for affordable housing.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Final Thoughts<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">While the Local Live bill has been a much-needed help to Florida\u2019s housing crisis, it is unlikely <\/span><span data-preserver-spaces=\"true\">to be<\/span><span data-preserver-spaces=\"true\"> enough, especially with the recent modifications. Florida is currently suffering from an ever-increasing wealth gap. On one hand, it is home to millions of visitors and boasts many millionaires living in luxury homes. <\/span><span data-preserver-spaces=\"true\">On the other<\/span><span data-preserver-spaces=\"true\">, the working and middle class are struggling to make ends meet.&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> presents a golden opportunity for investors to provide decent housing at a reasonable price. As with many expensive cities such as <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/markets?market=New%20York-Newark-Jersey%20City%2C%20NY-NJ\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">New York<\/span><\/a><span data-preserver-spaces=\"true\">, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/markets?market=San%20Francisco-Oakland-Fremont%2C%20CA\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">San Francisco<\/span><\/a><span data-preserver-spaces=\"true\">, and <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/markets?market=Los%20Angeles-Long%20Beach-Anaheim%2C%20CA\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Los Angeles<\/span><\/a><span data-preserver-spaces=\"true\">, co-living is a growing trend, allowing investors to own single-family homes <\/span><span data-preserver-spaces=\"true\">that they rent<\/span><span data-preserver-spaces=\"true\"> by the room. Websites such as <\/span><a class=\"editor-rtfLink\" href=\"http:\/\/coliving.com\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Coliving.com<\/span><\/a><span data-preserver-spaces=\"true\">, <\/span><a class=\"editor-rtfLink\" href=\"http:\/\/common.com\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Common Living<\/span><\/a><span data-preserver-spaces=\"true\">, and <\/span><a class=\"editor-rtfLink\" href=\"http:\/\/padsplit.com\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">PadSplit<\/span><\/a><span data-preserver-spaces=\"true\"> have thus recently increased in popularity to accommodate co-living\u2014a fancy term for having roommates.
