Many people prefer to put their money in the <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/real-estate-vs-stocks-performance\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">stock market<\/span><\/a><span data-preserver-spaces=\"true\"> because even with diligent screening, it\u2019s inevitable that you\u2019ll encounter tenants who fall behind on their rent. When that happens, your real estate becomes a massive headache. However, according to a recent article in the<\/span> <em><a class=\"editor-rtfLink\" href=\"https:\/\/www.wsj.com\/real-estate\/why-philadelphia-is-bucking-a-nationwide-surge-in-evictions-25df7ba7\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Wall Street Journal<\/span><\/a><\/em><span data-preserver-spaces=\"true\">, rent problems could be well on their way out.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">What Is Eviction Diversion?<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">The City of Brotherly Love, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/markets?market=Philadelphia-Camden-Wilmington%2C%20PA-NJ-DE-MD\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Philadelphia<\/span><\/a><span data-preserver-spaces=\"true\">, is spreading love to landlords and tenants through<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/eviction-diversion.phila.gov\/#\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> eviction diversion<\/span><\/a><span data-preserver-spaces=\"true\">. In short, it\u2019s like real estate marriage counseling. Instead of heading straight for a divorce\u2014i.e., an eviction\u2014landlords must enroll in out-of-court negotiations with tenants before they can sue to remove them.&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">If<\/span><span data-preserver-spaces=\"true\"> that sounds like another headache for landlords before the inevitable eviction happens<\/span><span data-preserver-spaces=\"true\">, the stats show otherwise<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\"> Philadelphia is known for low income and high eviction rates. However, since <\/span><span data-preserver-spaces=\"true\">eviction diversion was enacted<\/span><span data-preserver-spaces=\"true\">, court filings to remove tenants were down 41% in the 12 months ending in June, compared with the annual average between 2016 and 2019, according to the<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/evictionlab.org\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> Eviction Lab<\/span><\/a><span data-preserver-spaces=\"true\">, a research unit at Princeton University.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">How It Works<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">With eviction diversion, tenant negotiations start before the court gets involved. A program-appointed counselor negotiates on behalf of the tenant with the landlords. It\u2019s not Legal Aid in the traditional sense to delay evictions through loopholes and landlord oversights (though Legal Aid lawyers can <\/span><span data-preserver-spaces=\"true\">be used<\/span><span data-preserver-spaces=\"true\"> as negotiators), but rather an intermediary whose focus is getting the tenant current with their rent\u2014that means catching up with back rent while making on-time payments <\/span><span data-preserver-spaces=\"true\">going forward<\/span><span data-preserver-spaces=\"true\">.&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">How will they pay back rent that <\/span><span data-preserver-spaces=\"true\">was missed<\/span><span data-preserver-spaces=\"true\"> in the first place, you ask? <\/span><span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> is where the negotiator earns their keep (from the city, not the landlord) in finding creative ways to make up the shortfall. It can include apportioning tax refunds or some of their security deposit, using public rental assistance, and creating a payment plan to make additional payments toward the money owed.&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Of course, if the tenant does not agree to these terms, an eviction can continue as normal. A mutual agreement to move out without an eviction <\/span><span data-preserver-spaces=\"true\">is <\/span><span data-preserver-spaces=\"true\">reached<\/span><span data-preserver-spaces=\"true\"> in some instances<\/span><span data-preserver-spaces=\"true\">.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Why It Works<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">The eviction diversion program has proved so successful <\/span><span data-preserver-spaces=\"true\">because<\/span><span data-preserver-spaces=\"true\"> the negotiators can access funds on behalf of tenants that most landlords and tenants would find <\/span><span data-preserver-spaces=\"true\">difficult<\/span><span data-preserver-spaces=\"true\">\u2014<\/span><span data-preserver-spaces=\"true\">namely,<\/span><span data-preserver-spaces=\"true\"> rental assistance.<\/span><span data-preserver-spaces=\"true\">&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Why It Doesn\u2019t Work<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">In some cases, the eviction diversion is just delaying the inevitable. Out of desperation to stave off eviction, a tenant might agree to enter the program only to fall behind and face eviction again. After being in the program, the landlord can evict without delay.&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Despite the drop in evictions, the Pennsylvania Apartment Association has voiced its dissatisfaction with the program as it currently stands. <\/span><span data-preserver-spaces=\"true\">They would like <\/span><span data-preserver-spaces=\"true\">to see the City Council<\/span><span data-preserver-spaces=\"true\"> modify eligibility criteria to include lease violations, such as nonpayment of rent.<\/span><span data-preserver-spaces=\"true\"> They also want to expedite the eviction process when tenants renege on their end of the deal.&nbsp;&nbsp;&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">The Elephant in the Room: Unaffordable Rents<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">No amount of negotiations will be able to solve the issue of a tenant simply not being able to afford their rent. In Philadelphia, 35% of renter households make enough to afford a median-priced apartment in the city, compared to 39% nationally. And in recent months, many big cities have seen explosive rent increases.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">A recent article in<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.cnn.com\/2024\/08\/27\/economy\/housing-affordability-top-five-cities\/index.html\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> CNN<\/span><\/a><span data-preserver-spaces=\"true\"> quoted Moody\u2019s Analytics data that said renters in <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/markets?market=New%20York-Newark-Jersey%20City%2C%20NY-NJ-PA\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">New York City<\/span><\/a><span data-preserver-spaces=\"true\">, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/markets?market=Miami-Fort%20Lauderdale-Pompano%20Beach%2C%20FL\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Miami<\/span><\/a><span data-preserver-spaces=\"true\">, Fort Lauderdale, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/markets?market=Los%20Angeles-Long%20Beach-Anaheim%2C%20CA\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Los Angeles<\/span><\/a><span data-preserver-spaces=\"true\">, and Northern New Jersey allocated more than 30% of their income toward rent in the second quarter. However, an increase in construction in <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/markets?market=Tampa-St.%20Petersburg-Clearwater%2C%20FL\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Tampa<\/span><\/a><span data-preserver-spaces=\"true\">, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/markets?market=Denver-Aurora-Lakewood%2C%20CO\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Denver<\/span><\/a><span data-preserver-spaces=\"true\">, and <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/markets?market=Minneapolis-St.%20Paul-Bloomington%2C%20MN-WI\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Minneapolis<\/span><\/a><span data-preserver-spaces=\"true\"> has seen shelter costs decrease.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">\u201cIt\u2019s heartbreaking when I look at the data for New York,\u201d said Lu Chen, senior economist at Moody\u2019s Analytics, the lead author of the group\u2019s<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cre.moodysanalytics.com\/insights\/market-insights\/q2-2024-housing-affordability-update\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> report<\/span><\/a><span data-preserver-spaces=\"true\"> quoted by CNN. \u201cThere is <\/span><span data-preserver-spaces=\"true\">just<\/span><span data-preserver-spaces=\"true\"> no way that many families, depending on the household structure, can afford to live in any unit without sharing.\u201d<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">The Panacea for Landlords: Rental Assistance<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">Rental assistance became a common term for landlords and tenants during the COVID-19 pandemic. It is a pivotal tool in making eviction diversion work. <\/span><span data-preserver-spaces=\"true\">A<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/home.treasury.gov\/policy-issues\/coronavirus\/assistance-for-state-local-and-tribal-governments\/emergency-rental-assistance-program\/promising-practices\/eviction-diversion\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> government website<\/span><\/a><span data-preserver-spaces=\"true\"> dedicated to eviction diversion details how rental assistance and other government programs enable the program to work.<\/span><span data-preserver-spaces=\"true\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Of particular interest to landlords is the sentence: \u201cTreasury strongly encourages grantees to require landlords that receive funds under the ERA [Emergency Rental Assistance], as a condition of receiving the funds, not to evict tenants for nonpayment of rent for 30 to 90 days longer than the period covered by the rental assistance.\u201d<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Will Eviction Diversion Become Part of the Rental Landscape?<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">Courts in Alaska, Indiana, Texas, Michigan, and other states have utilized types of eviction diversion programs.<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/nlihc.org\/resource\/new-jersey-launches-eviction-diversion-and-legal-services-program-low-income-households\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> New Jersey<\/span><\/a><span data-preserver-spaces=\"true\"> has introduced the Comprehensive Eviction Defense and Diversion (CEDD) program to each of the state\u2019s 15 court districts, using funds from the<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.dol.gov\/general\/american-rescue-plan\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> American Rescue Plan Act<\/span><\/a><span data-preserver-spaces=\"true\">, which was initially introduced to help with the<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/home.treasury.gov\/policy-issues\/coronavirus\/assistance-for-state-local-and-tribal-governments\/state-and-local-fiscal-recovery-funds\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> effects of the pandemic<\/span><\/a><span data-preserver-spaces=\"true\"> but is now <\/span><span data-preserver-spaces=\"true\">being used<\/span><span data-preserver-spaces=\"true\"> for the housing affordability crisis. The long-term use of eviction diversion procedures depends heavily on whether rental affordability continues to be an issue in American cities.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Final Thoughts&nbsp;<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">Although evictions are down dramatically in Philadelphia while nationally, they have<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.wsj.com\/economy\/housing\/evictions-surge-in-major-cities-in-the-american-sunbelt-7da0406d?mod=article_inline\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> surged back to pre-pandemic<\/span><\/a><span data-preserver-spaces=\"true\"> levels, statistically, eviction diversion is working. Had the program failed, evictions would have only stalled temporarily. The program is targeted specifically to help low-income tenants, which has always been the most problematic rental sector for landlords.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">On paper,<\/span><span data-preserver-spaces=\"true\"> less expensive properties where lower-income tenants live are the most profitable due to potential <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/rental-property-cash-flow-analysis\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">cash flow<\/span><\/a><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\"> However, this <\/span><span data-preserver-spaces=\"true\">is rarely achieved<\/span><span data-preserver-spaces=\"true\"> due to high repair costs, labor-intensive management, and evictions\/nonpayment of rent. It would be wonderful if this weren\u2019t the case, as it is usually the entry point to landlording for many investors and often proves so traumatic an experience that it puts them off investing for good.
