{"id":178497,"date":"2024-10-21T16:16:43","date_gmt":"2024-10-21T22:16:43","guid":{"rendered":"https:\/\/www.biggerpockets.com\/blog\/?p=178497"},"modified":"2024-10-21T16:17:35","modified_gmt":"2024-10-21T22:17:35","slug":"californias-prop-33-and-what-it-could-change-for-investors","status":"publish","type":"post","link":"https:\/\/www.biggerpockets.com\/blog\/californias-prop-33-and-what-it-could-change-for-investors","title":{"rendered":"Proposition 33 Ignites Fierce Debate Over California Rent Control Laws"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Proposition 33\u2014a measure on this year&#8217;s California election ballot that would increase rent control laws by limiting the amount landlords can charge for rent, regardless of an apartment\u2019s rental history, and expanding them to single-family homes\u2014is viewed as pivotal by its advocates and opponents in the fight for housing affordability.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Nowhere is homelessness and affordability more of a <\/span><span data-preserver-spaces=\"true\">key<\/span><span data-preserver-spaces=\"true\"> issue than in California. Recent data shows that nearly <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/calmatters.org\/housing\/homelessness\/2024\/09\/pit-count-analysis-2024\/#:~:text=New%20data%20shows%20nearly%20186,000,efforts%20to%20stem%20the%20tide.\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">186,000 people<\/span><\/a><span data-preserver-spaces=\"true\"> now live on the streets and homeless shelters in the state.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">And it\u2019s not just in California: In 2022, according to a <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.jchs.harvard.edu\/sites\/default\/files\/interactive-item\/files\/Harvard_JCHS_Americas_Rental_Housing_2024_Press_Release.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Harvard study<\/span><\/a><span data-preserver-spaces=\"true\">, more than 50% of tenant households in the U.S. paid more than 30% of their income on rent and utilities, making them cost-burdened, and a quarter spent half their income on housing.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Pros and Cons of Rent Control<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Rent control can be an invaluable safety valve for soaring rents, giving tenants a relatively affordable place to live in pricey cities where working- and middle-class workers are sorely needed. <\/span><span data-preserver-spaces=\"true\">Landlords complain<\/span><span data-preserver-spaces=\"true\">, however,<\/span><span data-preserver-spaces=\"true\"> when rent-controlled apartments are passed on from one tenant to another within the same family, leading to generations of tenants living in rent-controlled buildings.<\/span><span data-preserver-spaces=\"true\"> Also, rent control can affect the landlord&#8217;s ability to keep up with costs, ultimately hurting building maintenance.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">What Passing Proposition 33 Would Do<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Prop 33 limits how much landlords can charge for rent, even when a rental unit has been vacated.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Currently,<\/span> <a class=\"editor-rtfLink\" href=\"http:\/\/costa-hawkins.com\/what-is-costa-hawkins\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">the Costa-Hawkins Rental Housing Act<\/span><\/a><span data-preserver-spaces=\"true\"> bans localities from capping rent on vacant units, single-family homes, and apartments built after Feb. 1, 1995.<\/span><span data-preserver-spaces=\"true\"> State law limits <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.latimes.com\/california\/story\/2024-02-07\/how-much-can-your-rent-go-up-in-california-check-this-website\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">rent increases<\/span><\/a><span data-preserver-spaces=\"true\"> for <\/span><span data-preserver-spaces=\"true\">tenants in apartments<\/span><span data-preserver-spaces=\"true\"> and corporate-owned single-family homes older than 15 years. The cap is set at 5% plus inflation, with a maximum increase of 10%. Local jurisdictions have leeway to impose stricter caps with no limits.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Currently, there is <\/span><span data-preserver-spaces=\"true\">something of<\/span><span data-preserver-spaces=\"true\"> a <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.latimes.com\/california\/story\/2024-04-29\/rent-control-isnt-just-for-older-buildings-in-los-angeles-developers-are-building-new-apartments-despite-rent-caps\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">gray area<\/span><\/a><span data-preserver-spaces=\"true\"> surrounding rent control on single-family homes and apartments built after Feb. 1, 1995.<\/span> <span data-preserver-spaces=\"true\">State law generally prohibits it, though it is <\/span><span data-preserver-spaces=\"true\">not always<\/span><span data-preserver-spaces=\"true\"> enforced.<\/span><span data-preserver-spaces=\"true\"> The cut-off date is earlier in some areas, such as in <\/span><span data-preserver-spaces=\"true\">the City of<\/span><span data-preserver-spaces=\"true\"> Los Angeles.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Proponents of Prop 33<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">The measure has many advocates and was sponsored by the AIDS Healthcare Foundation, a Los Angeles nonprofit active in housing issues in recent years that has contributed nearly<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.latimes.com\/politics\/story\/2024-09-27\/proposition-33-money-support-opposition-californias-statewide-ballot-measure\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> $47 million in support<\/span><\/a><span data-preserver-spaces=\"true\">. Labor and tenant organizations, including Unite Here Local 11 and the Coalition for Economic Survival, as well as the California Democratic Party and the ACLU of Southern California, have also endorsed the measure.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Opponents<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Many in the real estate industry oppose Prop 33. <\/span><span data-preserver-spaces=\"true\">The California Apartment Association\u2014which <\/span><span data-preserver-spaces=\"true\">it says<\/span><span data-preserver-spaces=\"true\"> has 13,000 members and<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.latimes.com\/california\/story\/2024-07-05\/2024-california-election-proposition-33-rent-control-voter-guide\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> has contributed nearly $66 million to oppose the measur<\/span><span data-preserver-spaces=\"true\">e<\/span><\/a><span data-preserver-spaces=\"true\">\u2014<\/span><span data-preserver-spaces=\"true\">i<\/span><span data-preserver-spaces=\"true\">s<\/span><span data-preserver-spaces=\"true\"> organizing a campaign against it.<\/span><span data-preserver-spaces=\"true\"> So far, opponents, mainly investors, Realtors, and property managers, have raised over $100 million.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Why oppose Prop 33?<\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">If rent is unaffordable, endorsing Prop 33, a measure designed to offer rental relief, <\/span><span data-preserver-spaces=\"true\">surely<\/span><span data-preserver-spaces=\"true\"> makes sense? Opponents say the opposit<\/span><span data-preserver-spaces=\"true\">e\u2014<\/span><span data-preserver-spaces=\"true\">t<\/span><span data-preserver-spaces=\"true\">hat<\/span><span data-preserver-spaces=\"true\"> the measure could be counterproductive.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">It&#8217;s not just the real estate industry that thinks it&#8217;s a bad idea, but the editorial board of the<\/span><em><span data-preserver-spaces=\"true\"> LA Times<\/span><\/em><span data-preserver-spaces=\"true\">, too. <\/span><span data-preserver-spaces=\"true\">While the venerable newspaper said <\/span><span data-preserver-spaces=\"true\">they <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.latimes.com\/opinion\/story\/2024-10-11\/no-on-proposition-33-rent-control-housing-shortage-worse\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">support<\/span><span data-preserver-spaces=\"true\"> rent control<\/span><\/a><span data-preserver-spaces=\"true\"> and <\/span><span data-preserver-spaces=\"true\">have<\/span><span data-preserver-spaces=\"true\"> endorsed two previous initiatives that would have repealed or amended Costa-Hawkins, <\/span><span data-preserver-spaces=\"true\">they are not fans<\/span><span data-preserver-spaces=\"true\"> of Prop 33<\/span><span data-preserver-spaces=\"true\">, as they<\/span><span data-preserver-spaces=\"true\"> feel it could &#8220;make California&#8217;s housing shortage even worse by prohibiting the state from imposing any limits on rent controls set by cities and counties in the future.&#8221;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">As a result, they contend that anti-growth cities (<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.urbanexus.com\/blog\/2024\/6\/5\/nine-of-the-ten-most-nimby-us-cities-are-in-the-sf-bay-area\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">NIMBYs<\/span><\/a><span data-preserver-spaces=\"true\">) could leverage their authority over rent control to require that developers set <\/span><span data-preserver-spaces=\"true\">extremely low<\/span><span data-preserver-spaces=\"true\"> rent caps on new apartment buildings, which would make new <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/finding-multifamily-properties\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">multifamily<\/span><\/a><span data-preserver-spaces=\"true\"> housing financially unfeasible.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Conversely, cities that want to keep rents affordable could impose &#8220;vacancy control,&#8221; which means rents stay capped even after a tenant moves out, or they could insist that new constructions are rent-controlled. Both measures could discourage developers from building affordable housing.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Other opponents fear rent control laws could cause landlords of unregulated apartments to increase rents even more because of demand. Rent control could also hurt landlords whose expenses are not controlled, causing them to forgo repairs and stop further investment in new units.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">A Possible Solution<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Rather than the broad strokes of Prop 33, opponents feel that amending or repealing Costa-Hawkins would allow cities more flexibility instead of a one-size-fits-all approach\u2014with safeguards in place to prevent flexibility turning into autonomy that would affect future housing construction.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">A previous initiative by <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.forbes.com\/sites\/brendarichardson\/2023\/03\/23\/national-apartment-association-study-finds-that-rent-control-is-not-the-solution-it-appears-to-be\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Berkeley officials in 2020<\/span><\/a><span data-preserver-spaces=\"true\"> considered &#8220;rolling rent control,&#8221; which would slowly expand the number of regulated units by applying rent control to properties as soon as they turned 10 or 15 <\/span><span data-preserver-spaces=\"true\">years old<\/span><span data-preserver-spaces=\"true\">. This would allow developers to use market rents to pay off the costs of a new building before rent control caps came into effect.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Wider Ramifications<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">According to the <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/nlihc.org\/resource\/nlihc-releases-four-new-tenant-protections-toolkits\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">National Low Income Housing Coalition<\/span><\/a><span data-preserver-spaces=\"true\">, over 300 new tenant protections have been implemented since January 2021. Many states are watching the outcome of Prop 33 with avid interest, and rent control advocates are looking to leverage a passing vote into rent control expansion nationwide.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">What Prop 33 Could Mean for Investors<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Generally <\/span><span data-preserver-spaces=\"true\">speaking<\/span><span data-preserver-spaces=\"true\">, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.forbes.com\/sites\/brendarichardson\/2023\/03\/23\/national-apartment-association-study-finds-that-rent-control-is-not-the-solution-it-appears-to-be\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">most real estate investors do not favor rent control<\/span><\/a><span data-preserver-spaces=\"true\"> for obvious reasons. Taxes, insurance, repairs, and interest rates have all increased precipitously in recent years. Landlords use rents to cover these expenses, and without a comparable increase, buildings inevitably suffer.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">In addition, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/commercial-real-estate-investing-for-beginners\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">commercial<\/span><\/a><span data-preserver-spaces=\"true\"> buildings are valued based on their rent roll. Limiting their value also denies developers the leverage to build or buy other housing.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">However, the sheer volume of people needing housing and the city&#8217;s willingness to find them should mean that <\/span><span data-preserver-spaces=\"true\">affordably priced<\/span><span data-preserver-spaces=\"true\"> units and homes will remain rented, adding a certain degree of stability to a notoriously unstable industry. It&#8217;s a delicate balance with no easy solutions.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Possibly the hardest-hit investors by Prop 33&#8217;s potential passing would be smaller mom-and-pop landlords, who cannot recoup the losses that rent control would bring the way larger landlords can.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">&#8220;Mom-and-pop landlords typically don&#8217;t raise rents as often as corporate landlords, but rent control forces them to keep increasing rent or risk falling behind, particularly when a tenant moves out,&#8221; Alexandra Alvarado, director of marketing and education at <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.american-apartment-owners-association.org\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">American Apartment Owners Association<\/span><\/a><span data-preserver-spaces=\"true\">, an industry group that helps landlords with tenant screening and other services, told <\/span><em><a class=\"editor-rtfLink\" href=\"https:\/\/nevadacurrent.com\/2024\/10\/14\/californias-rent-control-ballot-measure-could-reverberate-across-the-us\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Nevada Current<\/span><\/a><\/em><span data-preserver-spaces=\"true\">.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Final Thoughts<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Everyone agrees that affordable housing is sorely needed. <\/span><span data-preserver-spaces=\"true\">What most people <\/span><span data-preserver-spaces=\"true\">disagree<\/span><span data-preserver-spaces=\"true\"> on is how to achieve it.<\/span><span data-preserver-spaces=\"true\"> Investors are the backbone of the rental housing industry, and their ability to run their businesses effectively and efficiently helps them stay afloat and benefits the tenants they house. Equally, tenants need to be able to afford a place to live.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Finance needs to come from somewhere to bridge the gap. A Berkeley proposal, touted by <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.bpoa.org\/news\/renters-relief-and-homeowners-protection-act\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">landlord groups<\/span><\/a><span data-preserver-spaces=\"true\">, suggests <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.eastbaytimes.com\/2024\/09\/11\/measure-cc-measure-bb-berkeley-renters-protections\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">expanding rent control exemptions<\/span><\/a><span data-preserver-spaces=\"true\">, directing some city revenue to property owners on tenants&#8217; behalf, and restricting the authority of the city&#8217;s rental oversight board.
