{"id":178763,"date":"2024-11-04T14:02:06","date_gmt":"2024-11-04T21:02:06","guid":{"rendered":"https:\/\/www.biggerpockets.com\/blog\/?p=178763"},"modified":"2024-11-06T10:45:15","modified_gmt":"2024-11-06T17:45:15","slug":"votes-on-housing-to-watch-this-election","status":"publish","type":"post","link":"https:\/\/www.biggerpockets.com\/blog\/votes-on-housing-to-watch-this-election","title":{"rendered":"13 Votes on Housing Proposals to Watch On Election Day"},"content":{"rendered":"\n<p><em>Updated with voting results on Wednesday, November 6.<\/em><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">California isn&#8217;t the only state that will decide on <\/span><span data-preserver-spaces=\"true\">important<\/span><span data-preserver-spaces=\"true\"> housing issues at the ballot box on Nov. 5, but it is one of the most prominent. Thirteen state and local ballot measures concerned with <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/finding-multifamily-properties\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">multifamily<\/span><\/a><span data-preserver-spaces=\"true\"> or landlord-tenant relationships and housing laws will be decided when voters go to the polls.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Here\u2019s a look at 13 proposals to watch on Election Day.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">California: Proposition 33<\/span><\/h2>\n\n\n\n<p><strong>Results: <\/strong>38.4% Yes &#8211; 61.6% No<\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">California&#8217;s Costa-Hawkins Rent Control Act mandated that rent control could not apply to any residential housing (including single-family homes) built after Feb. 1, 1995. Additionally, local laws cannot currently dictate what landlords can charge new renters when they first move in; they can only limit rent increases for existing renters.<\/span><\/p>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/californias-prop-33-and-what-it-could-change-for-investors\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Prop 33<\/span><\/a><span data-preserver-spaces=\"true\"> would increase rent control laws by limiting the amount landlords can charge for rent, regardless of an apartment&#8217;s rental history, and expanding them to single-family homes. Proponents of Prop 33 cite California&#8217;s unaffordable rent as a reason for tougher, further-reaching rent control laws, while opponents feel that the proposition would ward off future construction and investment\u2014the one thing affordable housing needs to alleviate the crisis.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Five local measures\u2014four in California and one in New Jersey\u2014could have a direct impact on multifamily operations and the landlord-tenant relationship:<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Berkeley, California: Measure BB<\/span><\/h2>\n\n\n\n<p><strong>Results: <\/strong>49.7% Yes &#8211; 50.3% No<\/p>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/ballotpedia.org\/Berkeley,_California,_Measure_BB,_Housing_and_Tenants%27_Rights_Measure_(November_2024)\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">The measure<\/span><\/a><span data-preserver-spaces=\"true\"> uses existing revenue to fund housing retention and homelessness prevention. It would remove some rent control and registration exemptions, allow tenant associations, and mandate that property owners meet with them. It would also modify some eviction conditions and eliminate rent control suspension during high vacancy. Additionally, the measure seeks to control how tenants could be charged for utilities and limit the maximum rent increase to 5%.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Berkeley, California: Measure CC<\/span><\/h2>\n\n\n\n<p><strong>Results: <\/strong>37.3% Yes &#8211; 62.7% No<\/p>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/ballotpedia.org\/Berkeley,_California,_Measure_CC,_Rent_Payment_Fund_Measure_Measure_(November_2024)\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">The measure<\/span><\/a><span data-preserver-spaces=\"true\"> seeks to use existing revenue to create a fund for rent payments to property owners. It also aims to expand exemptions from rent control and permit tenant associations while modifying some eviction conditions.&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">If passed, the measure would remove powers from the city&#8217;s rent board and raise the maximum rent increase to 7.1% from 7%. This measure conflicts with Measure BB, so if both pass, the one with the most votes would prevail and come into law.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Fairfax, California: Measure 1<\/span><\/h2>\n\n\n\n<p><strong>Results: <\/strong>66% Yes &#8211; 34% No<\/p>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/storage.googleapis.com\/proudcity\/fairfaxca\/2024\/07\/Resolution-24-48-Measure-to-Amend-Just-Cause-and-Rent-Stabilization.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">This measure<\/span><\/a><span data-preserver-spaces=\"true\"> repeals the city&#8217;s<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.townoffairfax.org\/rent-stabilization-and-just-cause-eviction-faqs\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> Just Cause Eviction<\/span><\/a><span data-preserver-spaces=\"true\"> and Rent Stabilization Ordinance. It replaces it with state law and prior town code.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">San Anselmo, California: Measure O<\/span><\/h2>\n\n\n\n<p><strong>Results: <\/strong>30.9% Yes &#8211; 69.1% No<\/p>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/www.marincounty.org\/depts\/rv\/election-info\/november-5-2024\/page-data\/tabs-collection\/measures\/measure-wording\/measureo\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">This<\/span><\/a><span data-preserver-spaces=\"true\"> requires property owners with three or more units to provide longer notices, offer relocation benefits, and the right to return to the apartment in a no-fault lease termination. It also mandates that landlords pay for temporary displacements.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Hoboken, New Jersey: Ballot Question<\/span><\/h2>\n\n\n\n<p><strong>Results: <\/strong>25% Yes &#8211; 75% No<\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Under current rent control laws, Hoboken&#8217;s landlords cannot raise rent by more than 5% or to the Consumer Price Index Rate\u2014whichever is greater. However, there is a caveat: If a unit has been occupied for three or more years and then goes vacant, a landlord can increase the rent by up to 25%.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">The <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.hobokennj.gov\/news\/future-of-rent-control-protections-on-november-ballot-in-hoboken\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">ballot question<\/span><\/a><span data-preserver-spaces=\"true\"> aims to change this. If passed, it would allow landlords to raise the rent on newly vacant rent-controlled units to market rates without restriction. This is regardless of the length of the previous lease, under the condition that the landlord makes a $2,500 contribution to Hoboken&#8217;s Affordable Housing Trust Fund. The units would then fall under rent control, with increases restricted while occupied.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Measures in California and Rhode Island <\/span><span data-preserver-spaces=\"true\">specifically<\/span><span data-preserver-spaces=\"true\"> concern approvals for affordable housing:<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">California: Proposition 5<\/span><\/h2>\n\n\n\n<p><strong>Results: <\/strong>44.2% Yes &#8211; 55.8% No<\/p>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240ACA10\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">This<\/span><\/a><span data-preserver-spaces=\"true\"> targets local ballot measures requiring bonds for affordable and public housing. Specifically, it amends the state constitution to lower the supermajority necessary to issue such bonds from 66.67% to 55%. This would also apply to future ballot measures concerning affordable housing funding.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Rhode Island: Question 3<\/span><\/h2>\n\n\n\n<p><strong>Results: <\/strong>65.5% Yes &#8211; 34.5% No<\/p>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/ballotpedia.org\/Rhode_Island_Question_3,_Housing_Acquisition,_Development,_and_Infrastructure_Bond_Measure_(2024)\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">This<\/span><\/a><span data-preserver-spaces=\"true\"> asks voters to authorize $120 million in bonds for housing development, including acquisition and infrastructure. $80 million of the money would be used specifically for affordable housing.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Five prominent affordable housing measures include:<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Baltimore, Maryland: Question A<\/span><\/h2>\n\n\n\n<p><strong>Results: <\/strong>Unavailable<\/p>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/elections.maryland.gov\/elections\/2024\/All_Local_Questions_PG24.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">This<\/span><\/a><span data-preserver-spaces=\"true\"> allows the city to borrow a maximum of $20 million to operate its affordable housing program.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Charlotte, North Carolina: Housing Bond Measure<\/span><\/h2>\n\n\n\n<p><strong>Results: <\/strong>63.6% Yes &#8211; 36.4% No<\/p>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/www.charlottenc.gov\/files\/sharedassets\/city\/v\/2\/growth-and-development\/documents\/bond\/statement-of-disclosure-filed-w-city-clerk-2.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">This measure<\/span><\/a><span data-preserver-spaces=\"true\"> uses increased property taxes to fund a $100 million affordable housing bond.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Los Angeles County: Measure A<\/span><\/h2>\n\n\n\n<p><strong>Results: <\/strong>55.7% Yes &#8211; 44.3% No<\/p>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/embed.documentcloud.org\/documents\/25199208-special-sales-tax-to-fund-homelessness-programs-and-lacahsa\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">This<\/span><\/a><span data-preserver-spaces=\"true\"> repeals and replaces the Measure H tax\u2014a quarter-cent sales tax expiring in 2027\u2014with a half-cent sales tax that supports affordable housing, among other causes.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Oroville, California: Measure N<\/span><\/h2>\n\n\n\n<p><strong>Results: <\/strong>Unavailable<\/p>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/buttevotes.net\/DocumentCenter\/View\/2783\/outgoing_standalone_small_vig_8-14-24_FINAL\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">This<\/span><\/a><span data-preserver-spaces=\"true\"> specifically addresses the approval of an 18-unit low-income housing property.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">San Francisco, California: Proposition G<\/span><\/h2>\n\n\n\n<p><strong>Results: <\/strong>56.6% Yes &#8211; 43.4% No<\/p>\n\n\n\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/www.sf.gov\/information\/proposition-g-funding-rental-subsidies-affordable-housing-developments-serving-low#:~:text=Proposition%20G:%20Funding%20Rental%20Subsidies,Persons%20with%20Disabilities%20%7C%20San%20Francisco\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">This<\/span><\/a><span data-preserver-spaces=\"true\"> apportions a minimum of $8.25 million annually to cover rental subsidies for extremely low-income affordable housing.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Final Thoughts<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">With the country in the grip of an affordable housing crisis, even if your state, city, or town does not have specific housing-related measures on the ballot, votes in the areas where they are\u2014principally in California\u2014could influence other parts of the country.
