{"id":183843,"date":"2025-07-16T14:10:25","date_gmt":"2025-07-16T20:10:25","guid":{"rendered":"https:\/\/www.biggerpockets.com\/blog\/?p=183843"},"modified":"2025-07-17T07:49:39","modified_gmt":"2025-07-17T13:49:39","slug":"newsom-makes-changes-to-california-environmental-law-to-help-spur-housing-development","status":"publish","type":"post","link":"https:\/\/www.biggerpockets.com\/blog\/newsom-makes-changes-to-california-environmental-law-to-help-spur-housing-development","title":{"rendered":"New Changes to an Environmental Law Could Create a Real Estate Boom in California"},"content":{"rendered":"\n<p><span data-preserver-spaces=\"true\">Housing developers may have thrown their hard hats into the air to celebrate the news that<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.gov.ca.gov\/2025\/06\/30\/governor-newsom-signs-into-law-groundbreaking-reforms-to-build-more-housing-affordability\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> California Governor Gavin Newsom is reforming the California Environmental Quality Act (CEQA<\/span><\/a><span data-preserver-spaces=\"true\">) to speed up new construction in the state.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">The Worst Housing Market in the Nation<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">California has experienced some of the worst housing shortages in the nation. According to estimates reported by Cal Matters, a nonprofit news organization, there is a shortfall of 3.5 million homes, with over 3 million renters and 1.5 million homeowners<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/econofact.org\/hitting-home-housing-affordability-in-the-u-s\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> exceeding the 30% and 50% thresholds<\/span><\/a><span data-preserver-spaces=\"true\"> for cost burden, respectively. <\/span><span data-preserver-spaces=\"true\">Homes in the state <\/span><span data-preserver-spaces=\"true\">are priced<\/span><span data-preserver-spaces=\"true\"> twice the national average, and rents are 50% higher, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/calmatters.org\/commentary\/2024\/12\/california-housing-crisis-worse\/#:~:text=li%3E%20%3C,the%20cost%20crisis.%E2%80%9D%3C\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Cal Matters<\/span><\/a> <span data-preserver-spaces=\"true\">reports<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">On July 1, Newsom signed two major laws overhauling the CEQA act, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/abcnews.go.com\/Politics\/wireStory\/gov-newsom-signs-housing-bill-overhauling-californias-landmark-123377288\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">declaring<\/span><\/a><span data-preserver-spaces=\"true\">, &#8220;This was too urgent, too important, to allow the process to unfold as it has for the last generation.&#8221;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Urban Areas Will Benefit the Most<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">The changes apply to a variety of different construction projects, including infill housing projects under 20 acres that aren&#8217;t in hazardous zones, childcare centers, food banks, wildfire mitigation efforts, advanced manufacturing, and even high-speed rail. Supporters of the changes believe the reforms will reduce costly project delays, which have deterred developers from building projects in the state in the past.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">&#8220;The impact of these bills will <\/span><span data-preserver-spaces=\"true\">be most pronounced<\/span><span data-preserver-spaces=\"true\"> in the state&#8217;s major metropolitan regions, where the housing crisis is most acute and the supply of infill-eligible land is most plentiful,&#8221; Meredith Parkin, environmental practice leader with multidisciplinary national consulting firm<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/esassoc.com\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> Environmental Science Associates<\/span><\/a><span data-preserver-spaces=\"true\">, told<\/span> <em><a class=\"editor-rtfLink\" href=\"https:\/\/www.forbes.com\/sites\/jamiegold\/2025\/07\/08\/new-ca-law-may-make-your-next-home-search-easier-more-affordable\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Forbes<\/span><\/a><\/em><span data-preserver-spaces=\"true\">.&nbsp;&nbsp;&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Slashes<\/span><span data-preserver-spaces=\"true\"> Costly Time Delays<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">The changes slash costly time delays for developers, <\/span><span data-preserver-spaces=\"true\">where,<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/calmatters.org\/housing\/2025\/06\/ceqa-urban-development-infill-budget\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> Cal Matters<\/span><\/a><span data-preserver-spaces=\"true\"> points out, they will no longer &#8220;have to study, predict, and mitigate the ways that new housing might affect local traffic, air pollution, flora and fauna, noise levels, groundwater quality, and objects of historic or archeological significance.&#8221;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Importantly<\/span><span data-preserver-spaces=\"true\">, the new reforms do not <\/span><span data-preserver-spaces=\"true\">change<\/span><span data-preserver-spaces=\"true\"> single-family zoning in the state, which means it <\/span><span data-preserver-spaces=\"true\">is likely skewed<\/span><span data-preserver-spaces=\"true\"> more toward rental units, <\/span><span data-preserver-spaces=\"true\">which affect<\/span><span data-preserver-spaces=\"true\"> middle- and lower-income communities,<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.ppic.org\/blog\/three-decades-of-housing-challenges-in-the-golden-state\/#:~:text=High%20housing%20costs%20have%20left,time%20to%20the%20same%20extent.\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> most <\/span><span data-preserver-spaces=\"true\">affected<\/span><span data-preserver-spaces=\"true\"> by the housing shortage<\/span><\/a><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\">&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Many real estate developers <\/span><span data-preserver-spaces=\"true\">feel<\/span><span data-preserver-spaces=\"true\"> that California has adopted an anti-development stance, which <\/span><span data-preserver-spaces=\"true\">has nothing to do with the environment<\/span><span data-preserver-spaces=\"true\"> but <\/span><span data-preserver-spaces=\"true\">is more aligned with<\/span><span data-preserver-spaces=\"true\"> anti-developer sentiments.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">It&#8217;s &#8220;one of the biggest obstacles to housing development\u2014even for small- and mid-scale residential projects that <\/span><span data-preserver-spaces=\"true\">are otherwise aligned<\/span><span data-preserver-spaces=\"true\"> with local planning goals,&#8221; San Francisco real estate professional<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.arezousf.com\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> Arezou Shadabadi<\/span><\/a><span data-preserver-spaces=\"true\"> told<\/span> <em><a class=\"editor-rtfLink\" href=\"https:\/\/www.forbes.com\/sites\/jamiegold\/2025\/07\/08\/new-ca-law-may-make-your-next-home-search-easier-more-affordable\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Forbes<\/span><\/a><\/em><span data-preserver-spaces=\"true\">, referring to CEQA. She added that over the past two decades, &#8220;I&#8217;ve seen CEQA weaponized by local groups, not for environmental reasons, but to block new housing.&#8221;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">She called CEQA &#8220;a tool for litigation rather than conservation.&#8221;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">\u201cA Rich Person&#8217;s Game\u201d<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">Jennifer Hernandez, a land use lawyer who runs the West Coast land use and environmental group for Holland and Knight, agreed, telling<\/span> <em><a class=\"editor-rtfLink\" href=\"https:\/\/www.multihousingnews.com\/ceqa-reforms-brighten-californias-housing-outlook\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Multihousing News<\/span><\/a><\/em><span data-preserver-spaces=\"true\">, &#8220;It became a hugely rich person&#8217;s game to try and develop in California because you had to have such staying power.&#8221;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">The Dissenters<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">The changes to CEQA have not been met with open arms everywhere. The news has particularly chagrined environmentalists and some politicians.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\"> &#8220;Jeopardizing those whole ecosystems, I think, is a risk that we don&#8217;t want to take,&#8221; State Senator Catherine Blakespear, a Democrat, told <\/span><em><span data-preserver-spaces=\"true\">The New York Times<\/span><\/em><span data-preserver-spaces=\"true\">. The environmental organization<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.sierraclub.org\/california\/sierra-club-california-statement-passage-trailer-bills\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> Sierra Club California<\/span><\/a><span data-preserver-spaces=\"true\"> has dismissed the overhaul as &#8220;half?baked,&#8221; warning that it &#8220;could disproportionately damage low?income neighborhoods and fragile ecosystems.&#8221;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Kim Delfino, an environmental lobbyist, <\/span><span data-preserver-spaces=\"true\">said<\/span><span data-preserver-spaces=\"true\"> the law would <\/span><span data-preserver-spaces=\"true\">allow<\/span><span data-preserver-spaces=\"true\"> the destruction of coastal habitats, forests, deserts, and grasslands.<\/span><span data-preserver-spaces=\"true\"> She called it the &#8220;worst bill&#8221; for imperiled species that she had seen in a quarter-century of advocacy.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">&#8220;It blows a hole in our efforts to protect habitat,&#8221; Delfino told lawmakers, the<\/span><em><a class=\"editor-rtfLink\" href=\"https:\/\/www.nytimes.com\/2025\/06\/30\/us\/california-environment-newsom-ceqa.html\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> New York Times<\/span><\/a><\/em><a class=\"editor-rtfLink\" href=\"https:\/\/www.nytimes.com\/2025\/06\/30\/us\/california-environment-newsom-ceqa.html\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> reported<\/span><\/a><span data-preserver-spaces=\"true\">. &#8220;Make no mistake, this will be devastating.&#8221;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">Overwhelmingly, though, the changes <\/span><span data-preserver-spaces=\"true\">appeared to be<\/span><span data-preserver-spaces=\"true\"> met positively, with most Democrats in the state falling in line with the governor. &#8220;The crisis has metastasized to such a level that our constituents are demanding it,&#8221; said assemblywoman Buffy Wicks, from the Bay Area, who wrote the bill to encourage high-density housing projects.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">How the Bill Helps Investors<\/span><\/h2>\n\n\n\n<p><span data-preserver-spaces=\"true\">California&#8217;s <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.ppic.org\/blog\/homelessness-hits-record-high-in-california-jumps-dramatically-in-rest-of-us\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">spiraling homelessness<\/span><\/a><span data-preserver-spaces=\"true\"> has overridden the need for painstakingly slow environmental protection, bringing developers back to the table.&nbsp;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">&#8220;This is major, major reform. We are thrilled.&#8221; Sean Burton, chief executive officer of Los Angeles-based multifamily developer Cityview, told <\/span><em><a class=\"editor-rtfLink\" href=\"https:\/\/www.wsj.com\/us-news\/thrilled-california-developers-cheer-rollback-of-states-environmental-law-3ba6f997?mod=real-estate_lead_story\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">The Wall Street Journal<\/span><\/a><\/em><span data-preserver-spaces=\"true\">.<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">&#8220;A lot of investors have redlined California,&#8221; Burton said, referring to developers who have disregarded California because of its environmental red tape. &#8220;Now, you&#8217;re going to see a lot of people give California a fresh look.&#8221;<\/span><\/p>\n\n\n\n<p><span data-preserver-spaces=\"true\">While larger developers are <\/span><span data-preserver-spaces=\"true\">no doubt<\/span><span data-preserver-spaces=\"true\"> rejoicing at the reforms, small developers also have reason to be <\/span><span data-preserver-spaces=\"true\">cheerful<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\"> Matt Lewis, director of communications for California YIMBU, told<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.bloomberg.com\/news\/articles\/2025-07-03\/california-s-pro-housing-yimbys-claim-win-in-ceqa-rollback\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> Bloomberg<\/span><\/a><span data-preserver-spaces=\"true\"> that it is now &#8220;historically, unprecedentedly fast and significantly cheaper to build infill housing up to seven stories around transit stops throughout the state.
