Will It Catch on Nationwide?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">The New York real estate community choked on their spreadsheets when mayoral candidate Zohran Mamdani proposed rent freezes on all rent-stabilized apartments. While his words <\/span><span data-preserver-spaces=\"true\">were primarily aimed<\/span><span data-preserver-spaces=\"true\"> at the powerful Wall Street <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/what-are-reits\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">REITs<\/span><\/a><span data-preserver-spaces=\"true\"> and large-scale landlords that own thousands of New York City apartment buildings, the policy could be most severely affected by the many mom-and-pop landlords who don&#8217;t have the resources to weather the consequences of stalled rents amid increasing expenses. Should Mamdani win the November election based on his tenant-friendly policies, it could have wider ramifications in other U.S. cities.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">A City of Renters<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Mamdani&#8217;s rent freeze stance resonated strongly with his voting base, as 39% of all New York City households were cost-burdened in 2024\u2014meaning they spent 30% of their income on housing\u2014according to the<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.osc.ny.gov\/press\/releases\/2024\/02\/dinapoli-housing-cost-burdens-new-yorkers-among-nations-highest\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> Office of the New York State Comptroller<\/span><\/a><span data-preserver-spaces=\"true\">. The numbers are even higher for renters, with 43% of people who lack the luxury of a stable housing payment being cost-burdened.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Unaffordable living accommodation is one of the <\/span><span data-preserver-spaces=\"true\">greatest<\/span><span data-preserver-spaces=\"true\"> sources of housing insecurity and the cause of both<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/odphp.health.gov\/healthypeople\/priority-areas\/social-determinants-health\/literature-summaries\/housing-instability\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> physical and mental illness<\/span><\/a><span data-preserver-spaces=\"true\"> amongst those who live under those conditions. Considering that approximately<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/comptroller.nyc.gov\/reports\/spotlight-new-york-citys-rental-housing-market\/#:~:text=New%20York%20is%20largely%20a,living%20in%20rent-regulated%20apartments.\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> 69%<\/span><\/a><span data-preserver-spaces=\"true\"> of households in New York City rent, Mamdani&#8217;s stance is widely popular amongst much of the city.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Building Owners of Six Units or More Could Be Subject to a Rent Freeze<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Buildings of six units or more are<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.wsj.com\/real-estate\/turning-new-york-offices-into-homes-finally-works-now-theres-a-rent-freeze-catch-c1f5f2a7?mod=article_inline\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> eligible <\/span><span data-preserver-spaces=\"true\">to be<\/span><span data-preserver-spaces=\"true\"> rent <\/span><span data-preserver-spaces=\"true\">stabilized<\/span><span data-preserver-spaces=\"true\">,<\/span><\/a><span data-preserver-spaces=\"true\"> which <\/span><span data-preserver-spaces=\"true\">comprises<\/span><span data-preserver-spaces=\"true\"> many buildings in the city <\/span><span data-preserver-spaces=\"true\">that<\/span><span data-preserver-spaces=\"true\"> smaller landlords <\/span><span data-preserver-spaces=\"true\">own<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\">&nbsp;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Paul Rahimian, CEO and founder of Parkview Financial, a commercial real estate lender, echoed the sentiments of many property owners in the city regarding a potential Mamdani victory. &#8220;The mayoral primary was the nail in the coffin. It would be the kiss of death if he won,&#8221; he <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.wsj.com\/real-estate\/commercial\/zohran-mamdani-nyc-rent-reaction-9ec352d1\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">told the <\/span><\/a><em><a class=\"editor-rtfLink\" href=\"https:\/\/www.wsj.com\/real-estate\/commercial\/zohran-mamdani-nyc-rent-reaction-9ec352d1\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Wall Street Journal<\/span><\/a><span data-preserver-spaces=\"true\">.&nbsp;<\/span><\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">&#8220;Comparative and Alternative Hardship&#8221; Exemption<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">However, Mamdani&#8217;s campaign contends he is not unsympathetic to the plight of landlords.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">&#8220;Zohran is committed to protecting the livelihoods of small landlords and maintaining a stable, functioning property market,&#8221; Dora Pekec, a Mamdani campaign spokeswoman, told the<\/span><em><span data-preserver-spaces=\"true\"> Wall Street Journal<\/span><\/em><span data-preserver-spaces=\"true\">. Mamdani advocates a &#8220;comparative and alternative hardship&#8221; exemption for landlords who can justify the need for rent increases, allowing officials to examine their business finances.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Building Expenses Could Spiral Out of Control<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Mamdani&#8217;s primary win and the prospect of a mayoral win have unsettled financial markets, with New York-based banks and REITs falling around 5% in the stock market back in June, according to <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.reuters.com\/business\/finance\/new-york-banks-reits-fall-mamdanis-mayoral-lead-stokes-rent-freeze-worries-2025-06-25\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Reuters<\/span><\/a><span data-preserver-spaces=\"true\">. One of the biggest fears among the real estate community is being unable to adjust rents to cover increasing financial obligations. The result could be landlords failing to make repairs, exacerbated by code violations from the city, and ultimately a decrease in rent-stabilized, affordable buildings in New York City\u2014counterproductive to Mamdani&#8217;s goals.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">&#8220;You have people running around saying, &#8216;No increases, no increases,&#8217; while everything is going up around you,&#8221; current mayor Eric Adams said at a<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.yahoo.com\/news\/articles\/mamdani-rent-freeze-promise-could-095500064.html\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> recent town hall<\/span><\/a><span data-preserver-spaces=\"true\">.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Boston Aims for the Middle Ground<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">New York is not the only big city with crippling housing issues. Boston residents are largely cost-burdened. However, rather than freeze rents entirely, the city has attempted to forge a middle ground that limits rent hikes.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">In early 2023, Mayor Michelle Wu filed a plan that capped rent increases for existing tenants at either 10% in high-inflation years or the Consumer Price Index (CPI) for the Boston area, plus six percentage points, whichever was lower, as reported<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.wbur.org\/news\/2023\/02\/14\/boston-mayor-rent-stabilization-control-housing-price?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> by WBUR<\/span><\/a><span data-preserver-spaces=\"true\">.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">The plan proposed exemptions, including owner-occupied buildings with six or fewer units, and for newer buildings within the first 15 years of receiving their certificate of occupancy, it <\/span><span data-preserver-spaces=\"true\">was<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/apnews.com\/article\/massachusetts-state-government-oregon-boston-211a01123b7691e0dc5dad8002c5009c\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> widely reported<\/span><\/a><span data-preserver-spaces=\"true\">. Wu&#8217;s policy advanced with<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.boston.com\/news\/real-estate\/2023\/03\/08\/boston-city-council-passes-rent-control-plan\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> broad support in March 2023<\/span><\/a><span data-preserver-spaces=\"true\"> and covered around 55% of Boston&#8217;s rental units, amounting to 185,000 dwellings.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Other Cities and States Considering Enacting Strong Rent Regulation Measures<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">While no other American cities have proposed an actual rent freeze, many have supported heightened rent regulation. Here&#8217;s a look at some of the initiatives <\/span><span data-preserver-spaces=\"true\">being considered<\/span><span data-preserver-spaces=\"true\">.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><span data-preserver-spaces=\"true\">Seattle, Washington<\/span><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Washington State recently emulated Boston&#8217;s proposal by passing HB 1217, a law that restricts rent increases for current tenants. The cap is 7% plus inflation or 10%, or whichever is lower. For manufactured home occupiers, the cap is lower\u20145% per year.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">There are some notable exemptions: new construction (exempt for 12 years) and affordable housing (run by nonprofits and housing authorities). However, rents for new tenants may <\/span><span data-preserver-spaces=\"true\">be set<\/span><span data-preserver-spaces=\"true\"> freely, and landlords must give 90 <\/span><span data-preserver-spaces=\"true\">days<\/span><span data-preserver-spaces=\"true\"> minimum written notice before raising rents.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Jay Parsons, an independent consultant and former chief economist at Richardson, Texas-based RealPage, told<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.multifamilydive.com\/news\/rent-control-Washington-legislation\/747994\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> multifamilydive.com<\/span><\/a><span data-preserver-spaces=\"true\">:<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em><span data-preserver-spaces=\"true\">&#8220;We&#8217;ve seen this elsewhere in places like New York, [where] they&#8217;ve expanded or revised the rent control rules\u2026four different times. <\/span><span data-preserver-spaces=\"true\">So I think <\/span><span data-preserver-spaces=\"true\">that<\/span><span data-preserver-spaces=\"true\"> the precedent <\/span><span data-preserver-spaces=\"true\">is going to<\/span><span data-preserver-spaces=\"true\"> likely lead some developers and investors <\/span><span data-preserver-spaces=\"true\">to <\/span><span data-preserver-spaces=\"true\">maybe not consider<\/span><span data-preserver-spaces=\"true\"> the state of Washington<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\"> Not everybody&#8217;s going to do that, but I think there&#8217;ll be others who&#8217;ll say, &#8216;We don&#8217;t want to mess with it.&#8217; It definitely adds a lot of risks to future investments.&#8221;<\/span><\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><span data-preserver-spaces=\"true\">Minneapolis, Philadelphia, San Francisco, and Berkeley, California&nbsp;<\/span><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">These are among the cities that have banned algorithmic rental price-fixing software, with Portland, <\/span><span data-preserver-spaces=\"true\">Oregon;<\/span><span data-preserver-spaces=\"true\"> Providence, Rhode <\/span><span data-preserver-spaces=\"true\">Island;<\/span><span data-preserver-spaces=\"true\"> and San Diego also exploring similar laws.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">&#8220;This wave of action shows that local governments are stepping up where federal enforcement takes time,&#8221; Ivan Luevanos-Elms, executive director of Local Progress, the national network helping coordinate the efforts, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/stateline.org\/2025\/03\/28\/cities-lead-bans-on-algorithmic-rent-hikes-as-states-lag-behind\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">told Stateline.org<\/span><\/a><span data-preserver-spaces=\"true\">.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span data-preserver-spaces=\"true\">Final Thoughts<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">Although large, expensive cities<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.credaily.com\/briefs\/economic-growth-cities-driving-americas-future\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> continue to drive economic growth<\/span><\/a><span data-preserver-spaces=\"true\"> in the U.S., they may not be the most sensible choice for real estate investors without deep pockets. While REITs and corporations have the luxury of riding out short-term volatility, many small investors who own six units or more are struggling. The lesson is simple: If you want to invest in cities with rigid rent regulation, stay in the one-to-four-family range.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">For larger investors, if rent regulation becomes too prohibitive, the outcome seems clear: They will <\/span><span data-preserver-spaces=\"true\">simply<\/span><span data-preserver-spaces=\"true\"> stop investing there and choose to put their money elsewhere.<\/span><span data-preserver-spaces=\"true\"> Unfortunately, many city lawmakers lack understanding of the <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/2016-01-31-9-hate-landlord\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">complexities of being a landlord<\/span><\/a><span data-preserver-spaces=\"true\"> and often paint everyone with a &#8220;greedy landlord&#8221; brush. However, when <\/span><span data-preserver-spaces=\"true\">repairs, taxes, insurance, and code updates cannot be easily kept up with<\/span><span data-preserver-spaces=\"true\">, landlords have the choice to decide that it&#8217;s simply not worth the hassle, which hurts everyone, but mostly tenants who need a place to live.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span data-preserver-spaces=\"true\">As recent examples have shown\u2014most notably in<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.wsj.com\/real-estate\/nyc-new-rochelle-lower-rent-e7695ded\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> New Rochelle, New York<\/span><\/a><span data-preserver-spaces=\"true\">\u2014the answer to rental growth is not to punish landlords, but to <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/florida-and-texas-will-account-for-30-percent-of-new-apartment-units-coming-online-this-year\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">build more housing<\/span><\/a><span data-preserver-spaces=\"true\">, not just luxury condos<\/span><span data-preserver-spaces=\"true\">, but quality<\/span><span data-preserver-spaces=\"true\"> housing for the middle class.<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.osc.ny.gov\/files\/reports\/pdf\/report-24-2025.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> New York City<\/span><\/a><span data-preserver-spaces=\"true\"> has steadily increased its housing supply, but it still lags behind the national average.
