{"id":187649,"date":"2026-04-22T11:01:51","date_gmt":"2026-04-22T17:01:51","guid":{"rendered":"https:\/\/www.biggerpockets.com\/blog\/?p=187649"},"modified":"2026-04-22T11:01:54","modified_gmt":"2026-04-22T17:01:54","slug":"sweeping-zoning-reforms-presents-opportunities-for-multifamily-investments","status":"publish","type":"post","link":"https:\/\/www.biggerpockets.com\/blog\/sweeping-zoning-reforms-presents-opportunities-for-multifamily-investments","title":{"rendered":"Sweeping Zoning Reforms Presents Opportunities For Multifamily Investments"},"content":{"rendered":"<p><span data-preserver-spaces=\"true\">With the affordability crisis stinging American pocketbooks and small landlords struggling to maintain <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/rental-property-cash-flow-analysis\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">cash flow<\/span><\/a><span data-preserver-spaces=\"true\"> amid high interest rates and property prices, the push for more housing is gaining traction on both sides of the aisle.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> has resulted in a quiet revolution amongst lawmakers, who have proposed sweeping zoning changes across 21 states that could enable roughly 173,000 additional homes every year, according to a new report by the<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.aei.org\/research-products\/report\/aei-state-housing-supply-legislative-update\/#:~:text=2026%20is%20shaping%20up%20to%20be%20the,Lot,%20Small%20Lot.%E2%80%9D%20Total%20projected%20extra%20homes\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> American Enterprise Institute<\/span><\/a><span data-preserver-spaces=\"true\">.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThings are getting worse, and that\u2019s why states are stepping in,\u201d the report&#8217;s author, Ed Pinto, told <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.homes.com\/news\/zoning-changes-proposed-across-the-us-could-add-172-700-homes-a-year-report-finds\/1801644148\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Homes.com<\/span><\/a><span data-preserver-spaces=\"true\">. \u201cWhen you require half-acre lots where they\u2019re not needed, you\u2019re keeping people from owning a home.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The proposals cover all residential housing types from condos to small <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/guides\/buying-multifamily\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">multifamily<\/span><\/a><span data-preserver-spaces=\"true\"> properties, creating opportunities for owner-occupant and mom-and-pop investors alike.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Increased Housing Shortage and Zoning Reform: The Ideal Couple<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">Last week, White House economists stated that the country was short by <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.pbs.org\/newshour\/politics\/the-u-s-is-short-10-million-houses-a-new-white-house-report-lays-out-a-blueprint-to-fix-that\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">10 million homes<\/span><\/a><span data-preserver-spaces=\"true\">, far exceeding <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.realtor.com\/research\/us-housing-supply-gap-2026\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">previous estimates<\/span><\/a><span data-preserver-spaces=\"true\">. The housing shortage has driven up rents, while higher interest rates and construction costs have deterred sellers from listing their homes and builders from building new properties.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The new proposals aim to add the so-called \u201cmissing middle\u201d-type properties to the housing equation, which, according to a 2023 op-ed in the <\/span><em><span data-preserver-spaces=\"true\">New York Daily News<\/span><\/em><span data-preserver-spaces=\"true\">, republished on the<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.aei.org\/op-eds\/how-hochul-housing-plan-can-pass\/#:~:text=The%20missing%20middle%20includes%20two%20and%20three-family,houses%20where%20teachers%20can%20afford%20to%20live.\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> AEI website<\/span><\/a><span data-preserver-spaces=\"true\">, \u201cincludes two- and three-family homes which young families can afford through rental income that helps pay the mortgage. It should include \u2018accessory dwelling units\u2019\u2014the \u2018granny flats\u2019 which allow older homeowners to move to a smaller place while staying in the town they know. The garages of raised ranch homes can become new apartments.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">In Connecticut, a new bill under consideration, nicknamed the \u201c<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.ctpublic.org\/news\/2026-04-17\/ct-golden-girls-bill-one-step-close-to-becoming-law\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Golden Girls bill<\/span><\/a><span data-preserver-spaces=\"true\">\u201d after the classic 1980s sitcom, would <\/span><span data-preserver-spaces=\"true\">let<\/span><span data-preserver-spaces=\"true\"> homeowners rent up to <\/span><span data-preserver-spaces=\"true\">three<\/span><span data-preserver-spaces=\"true\"> bedrooms in their single-family homes without requiring local government approval.<\/span> <span data-preserver-spaces=\"true\">It\u2019s aimed at empty nesters or older people <\/span><span data-preserver-spaces=\"true\">who are<\/span><span data-preserver-spaces=\"true\"> looking to <\/span><span data-preserver-spaces=\"true\">utilize<\/span><span data-preserver-spaces=\"true\"> their homes better.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The conversion <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.aei.org\/research-products\/report\/legalizing-single-family-home-conversions-to-duplexes-triplexes-or-townhomes-in-washington-dcs-new-comprehensive-plan\/#:~:text=Download%20PDF-,Legalizing%20Single-Family%20Home%20Conversions%20to%20Duplexes,%20Triplexes,%20or,Washington,%20DC&#039;s,%20New%20Comprehensive%20Plan&amp;text=We%20propose%20that%20the%20District,access%20to%20high-opportunity%20neighborhoods.\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">of single-family homes to duplexes, triplexes, or townhomes<\/span><\/a><span data-preserver-spaces=\"true\">, and the legalization of the construction of small <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.aei.org\/research-products\/report\/aei-state-housing-supply-legislative-update\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">multifamily homes<\/span><\/a><span data-preserver-spaces=\"true\"> where single-family zoning previously prevailed, represent a huge game changer for investors\u2014the opportunity to \u201csupersize\u201d their rental portfolios without having to find new properties.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Following Minneapolis\u2019 Example<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">Changing zoning laws to allow more housing is hardly a novel concept. <\/span><span data-preserver-spaces=\"true\">Minneapolis was a pioneer, allowing greater downtown and transit corridor density, eliminating parking requirements, and enabling <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/rookie-591\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">accessory dwelling <\/span><span data-preserver-spaces=\"true\">unit<\/span><\/a><span data-preserver-spaces=\"true\"> (<\/span><span data-preserver-spaces=\"true\">ADU<\/span><span data-preserver-spaces=\"true\">) <\/span><span data-preserver-spaces=\"true\">construction<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\"> One headline-grabbing change was ending single-family zoning, allowing two- and three-unit homes to <\/span><span data-preserver-spaces=\"true\">be built<\/span><span data-preserver-spaces=\"true\"> in every neighborhood.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Alex Horowitz, director of housing policy initiatives at Pew, told<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.npr.org\/2024\/02\/17\/1229867031\/housing-shortage-zoning-reform-cities\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> NPR<\/span><\/a><span data-preserver-spaces=\"true\"> in 2024, after <\/span><span data-preserver-spaces=\"true\">the changes were implemented<\/span><span data-preserver-spaces=\"true\">:<\/span><\/p>\n<p><em><span data-preserver-spaces=\"true\">&#8220;We saw Minneapolis add 12% to its housing stock in just that five-year period [between 2017 and 2022], far more than other cities. The zoning reforms made apartments feasible. They made them less expensive to build. And they were saying yes when builders submitted applications to build apartment buildings. So they got a lot of new housing in a short period of time.\u201d<\/span><\/em><\/p>\n<p><span data-preserver-spaces=\"true\">Minneapolis\u2019 success <\/span><span data-preserver-spaces=\"true\">was quickly followed<\/span><span data-preserver-spaces=\"true\"> by<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.sightline.org\/release\/oregon-legislature-passes-historic-statewide-us-affordability-measure\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> Oregon in 2019<\/span><\/a><span data-preserver-spaces=\"true\"> and<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.lincolninst.edu\/publications\/articles\/2022-12-state-by-state-guide-to-zoning-reform\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> California in the early 2020s<\/span><\/a><span data-preserver-spaces=\"true\">.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">The Play for Real Estate Investors<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">More units mean greater <\/span><span data-preserver-spaces=\"true\">potential for profits<\/span><span data-preserver-spaces=\"true\">. Depending on the jurisdiction, owners of single-family dwellings now have the option to either convert them into small multi-unit apartment buildings by adding kitchens and bathrooms or to add ADUs.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Additionally, rezoning a lot from single-family to multifamily increases land value, resulting in a windfall gain for the owner.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Investors looking for cash-flow opportunities can now target larger, older single-family homes <\/span><span data-preserver-spaces=\"true\">with an eye toward renovating them and converting<\/span><span data-preserver-spaces=\"true\"> them into multi-unit homes. For example, in areas that allow ADUs and additional units, <\/span><span data-preserver-spaces=\"true\">a large three-story house with room for an ADU could potentially be transformed<\/span><span data-preserver-spaces=\"true\"> into four separate units. Thus, purchasing four such properties could result in 16 units of cash flow, exponentially increasing profits.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Red Tape Still Exists<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">Although zoning changes represent a big breakthrough for owner-occupants looking to offset their housing costs and investors looking to maximize cash flow, as this op-ed from<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.governing.com\/urban\/it-takes-more-than-zoning-reform-to-get-more-housing\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> Governing.com<\/span><\/a><span data-preserver-spaces=\"true\"> explains, permits and approvals still fall to city building departments, and bottlenecks are common.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cZoning reform is real, widespread, and necessary\u2014but not sufficient on its own,\u201d author Deborah Myerson, founder and principal of Myerson Consulting, writes. \u201cThe question is no longer whether a jurisdiction has reformed its zoning code. It\u2019s whether those reforms are actually producing more housing.\u201d<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">An Investment Gold Rush Has Residents Worried<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">The NIMBY movement (Not In My Back Yard) has <\/span><span data-preserver-spaces=\"true\">been characterized<\/span><span data-preserver-spaces=\"true\"> as consisting of affluent homeowners in single-family-zoned areas who are vocally resistant to zoning changes that would allow greater housing density, including multifamily housing, to encroach on their neighborhoods and devalue their property. In many cases, prominent politicians have jumped into the fray.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cIt would erode local control, diminish community input on planning and zoning, and disproportionately impact low-resource neighborhoods,&#8221; <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/calmatters.org\/housing\/2025\/10\/newsom-signs-massive-california-housing-overhaul\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Calmatters<\/span><\/a><span data-preserver-spaces=\"true\"> reported Los Angeles Mayor Karen Bass as saying when urging California Governor Gavin Newsom to veto California\u2019s zoning changes to boost housing.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">ADUs <\/span><span data-preserver-spaces=\"true\">are thought<\/span><span data-preserver-spaces=\"true\"> to be a part of <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cayimby.org\/news-events\/press-releases\/new-law-ends-nimby-abuse-of-adu-permitting\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">20%<\/span><\/a><span data-preserver-spaces=\"true\"> of all new California home construction. To date, state laws have enabled the construction of over 35,000 new ADUs since 2016. However, local homeowner groups have complained that mandating higher housing levels would reshape suburban-style neighborhoods.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">The Cost of Scaling Up for Investors<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">For many investors, scaling their portfolio with ADUs comes down to one main question: How much does it cost? According to lender <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/civicfs.com\/resource\/should-you-add-an-adu-to-your-investment-property-pros-cons-and-financing-options\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">CIVIC<\/span><\/a><span data-preserver-spaces=\"true\">, typical ADUs cost between $180,000 and over $300,000, depending on location. The easiest way to finance them, if you don\u2019t have the cash, is to use the <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/what-is-home-equity\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">equity<\/span><\/a><span data-preserver-spaces=\"true\"> in your home or investment and take out a loan or line of credit.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Loans for non-owner-occupied ADUs can be difficult to arrange with traditional lenders, according to CIVIC<\/span><span data-preserver-spaces=\"true\">, though<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.loopnet.com\/cre-explained\/investing\/what-is-an-adu-and-its-impact-on-investment-properties\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"> LoopNet<\/span><\/a><span data-preserver-spaces=\"true\"> notes that ADUs can also <\/span><span data-preserver-spaces=\"true\">be financed<\/span><span data-preserver-spaces=\"true\"> through FHA renovation loans, portfolio loans, and commercial real estate (CRE) loans.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Final Thoughts<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">Adding units sounds good in theory, but as with any construction project, overruns can be costly, especially when structural changes and new plumbing <\/span><span data-preserver-spaces=\"true\">are factored in<\/span><span data-preserver-spaces=\"true\">. <\/span><span data-preserver-spaces=\"true\">Landlords will have to make a calculation based on potential cash flow <\/span><span data-preserver-spaces=\"true\">versus the cost of<\/span><span data-preserver-spaces=\"true\"> construction and tax benefits.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Building an ADU into a preexisting structure, such as a garage or a basement conversion, is generally cheaper to build but may not generate as much rental income or <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.biggerpockets.com\/blog\/what-is-appreciation-in-real-estate\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">appreciation<\/span><\/a><span data-preserver-spaces=\"true\"> as a completely detached ADU.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Currently, as new zoning laws are <\/span><span data-preserver-spaces=\"true\">being implemented<\/span><span data-preserver-spaces=\"true\">, there still seems to be a disconnect in some circumstances between state ADU laws and local zoning restrictions.
