HOA in litigation, suing contractor for taking $$

Looking to purchase a beach townhouse 2nd home. The HOA is in litigation against a contractor that took the money after hurricane Matthew but never completed the work. HOA already remediated the issues. How does this affect my financing? Thanks in advance
