Historic homes and real estate contract question

Scott O'Brien

What section of a real estate contract would be used to list whether a property designated as a historic landmark has actual improvement restrictions on it, as opposed to just listing it as a historic property?  Some houses may be historic, but not have county, state or federal restrictions.

Your local/state laws will dictate what must be disclosed but in order to avoid liability it has always been my practice to disclose EVERYTHING.

Your contract should have either a section on the form itself or an addendum for disclosures.  It would go there.

Well, if it was as clear cut as that, I wouldn't be asking. I've been consulting with an attorney who says there is no specific section for that information to appear.
