Foreclosing / evicting an owner finance tenant in Texas

I have a home I owner financed back in 2013 and since July of 2016 he has been getting further and further behind. The deal was done through an attorneys office and my question is what do I do from here? I have reached out several times and "he is doing all he can do" which is pays about every other month. His payment is $750 a month and without any late fees he currently owes about $2250. I am in East TX and know I can call the attorney (I'm sure for a fee) but I figured I would see if anyone on here had any advice. I have the contract and it states the attorney can act as trustee to foreclose but not sure if I have any rights of legally evicting prior to the court house sale. Any advice would be greatly appreciated!
