Lease Terms to ensure payment of the last month rent
Hello Fellow BP-ers,
Recently my tenants gave me notice to vacate and told me that they will NOT be paying the last month rent and asked me to take it from the deposit. I could not convince them otherwise. Now they have vacated and there are lots of things I need to fix. All of those costs need to come out of my pocket.
I can use your collective wisdom on how to structure the terms for the tenants going forward. One idea I heard was to ask for Last Month Rent also along with First Month Rent + Deposit at the time of signing the lease. Has anyone tried it? Potentially the tenants can say that they are NOT going to pay the rent for last two months nullifying the benefit of collecting the last month rent in advance, right?
Are there any other suggestions or ideas that you have tried? I'm open to any suggestions.

This is why many Landlords require first, last, and deposit. If you don't have last month's rent, it's too easy for the tenant to not pay and leave you stuck with cleaning and repairs.
I personally don't charge last month's rent. With 400 rentals, not even 1% of my tenants leave without paying their last month. However, if someone is a higher-risk Applicant, then I will charge 1.5x or 2x the monthly rent for their deposit. I have 150-180 turnovers per year and maybe 1% of them leave owing more money than I have on deposit.

I charge an amount higher than the monthly rent for the deposit. This way they clean the house and pay the last month's rent to get their large deposit back. If they break the lease the deposit is forfitted.
