Parental consent needed for my tenant's GF to stay with him?

Hello, Wonderful People of The BiggerPockets Community!

 I have a house in the Denver area that I house hack. This Summer I have a student from California coming to Colorado for an internship. He is 21 but he is going to drive from Cali with his girlfriend, she is going to stay for a few days with him in Colorado then fly back out to Cali.

My issue is that she is not 21 yet, she will be in November 2023. Do I need to obtain her parents consent if she stays in my house, with my tenant? Can I be in trouble if I do not obtain a parent's consent?

The scenario you describe is just a tenant with a guest for a few days, but your lease hopefully explains how long a guest can stay because sometimes guests end up sticking around and moving in. I believe my lease allows guests to stay for 30 days per year otherwise they have to be added to the lease.

Why would you need parental consent? She's currently 20 years old, a legal adult. Her parents have no say whatsoever what she does.

Once a person reaches the age of 18, they are adults and can sign contracts or take responsibility for themselves.

You don't need to do anything for a guest. I recommend you determine what constitutes a guest vs. an occupant, develop a policy, and then move forward.

My policy says guests can stay for up to 8 days a month without my permission.

Thank you Nathan, your answer is very helpful. Since I did not grow up in the US I wasn't sure if 18 or 21 was the adult age. It seems like 21 is only for alcohol and smoking then!

Each state sets the age of majority (adulthood). Alabama and Nebraska are 19 years old and Mississippi is 21 (last I heard the state government was trying to change this to 18). All other states are 18 years old.

I believe the age 21 in Mississippi applies only to a minors ability to sign contracts.
