Can you get rid of 1 renter - of a former pair

2 Replies

So, I've had this couple live in one of my houses +2 years. Always paying the rent on time.

I had an initial lease for 12 months, which rolled into month-to-month.

The Woman approached me a couple of times with this: Supposedly she and her boyfriend have broken up and she's paying the rent every month and he just lives there. She can't get rid of him and she asked me, if I can evict him.

I've told her that I can't just evict one person, since they both signed the lease. I would have to name both of them on the eviction paperwork, which would hurt her credit. Also, if she moved out and he's still there, not paying, I'd have to evict her by name as well.

It seems that she's between a rock and a hard place.

Would you do anything or just ignore it, as long as the rent is paid? Or would you have any suggestions on what she could do to get him to move out?

@Michaela G.

If they are month-to-month, maybe you can give both of them a 30 days notice to end the lease. When the 30 day period is up, you can sign a new lease with her. Does that work?

Maybe. What would I do, if he doesn't leave? I would still have to evict both of them, because they're both on the lease, right?
