Signing lease then discovering was home to former smokers. When we signed the lease the windows were open, the house smelled ok and we could not smell any smoke. 4 days later we moved in and the house smelled of smoke all the time unless the windows were open. The landlord did not disclose to us that the former tenants were smokers and we did not ask. After moving in my wife got sick from the smell and we are unable to live there. The landlord does not want to give us our money back. All that was said in the contract is that we deemed the property habitable. Do we have any recourse to move out and get our money back?
