What’s your experience with Wagner Nolasco B2RDirect

Hello, My fiancé and I are about to wire down payment to invest for 3/2 SFR in Ocala, FL. It's a new construction building which will be finished building in Sep/Oct 2022. However, B2RDirect hasn't been provide any of pictures of real buildings yet. They only shared a master plan and pro foma with us. We were skeptical at first but then it is backed and recommended by senior counselor at NORADA company ( if anyone knows about Marco Santarelli). After I have read a bad review about this company on BiggerPockets forum, we are hesitant to move forward. We would like to hear from REI experts who have any experience with this company. Help, please~ We'd appreciate it. thanks.

Wagner, After reading all the disgruntled messages on this board, in an effort to re-instill confidence in your investors, can you please advocate for us and push D32 builders and Werner Macedo to remove the escalation clause & lock-in our original purchase price? This action would greatly enhance investor confidence, demonstrate goodwill, and help safeguard our investments. Your advocacy in this matter is crucial for mitigating risks and protecting the equity rightfully belonging to us.

With all the negative comments and concerns over the houses not being completed per the contract dates, perhaps all the investors should speak to a local real estate attorney and see if they can get their money back or other concessions.  I personally used Jon McGraw in the past and he is extremely knowledgeable in the field.  It's certainly worth the cost of having him review the contracts and inform you of your rights.

It was a pleasure to have spoken to you yesterday. As I had mentioned on the call it is better to consult an attorney if you have any questions regarding the contract. 

Also, I'm contacting some Florida attorneys, and if you need referrals I will gladly assist with 2-3 names.

Hi Wagner, immediately after our call about 10 days ago now I emailed you and the builder directly several unanswered questions I had.  You had encouraged us to reach out to the builder and said you could even facilitate but I haven’t received a reply still.  Please let me know how I can help. Thank you.

Good morning Hares, as you know I will always try to streamline communication and try to assist. But, I can't control how quickly the seller responds. I have just sent another email to the seller and you requesting a reply from him. If you may please send me an email or text when you need additional help as I don't access this blog very often. Thank you

Let me be very honest, be very careful when you go through Wagner. All he will do is always appear to be supportive, once the contract is signed/paid by us and then things delay over 2 years and more - he will appear helpless. You will keep hearing that he will support you in all ways and means in emails and in forums - but actually there is no support. I have been in a situation where i paid 20% for my two properties and it is 3 years now and even yesterday Wagner promised me all support on email when i tried to reach the builder and addressed him as well, i don't know what support though :). I know multiple folks in my same situation, so i just caution you all to be careful and not go through the experience we went through. 

Always get a home that is fully complete and ready to move in, that is my 2 cents from all this experience.

If anything changes in my case i will definitely post here and keep you all informed. If i do get help i will gladly post here like i posted my bad experience.

Good afternoon Vinod, we have spoken several times and I have always been here to help you, with support and transparency. As you know im the broker for the transaction, not the builder and not the seller. I wish I had control over the deliveries but I dont. every call you have scheduled I have been there for you and all of our clients.  I have no control on the builders delays and deliveries. I will always be here to support on everything that you need until all situation is resolved. But, please make sure you account responsibilities where they belong. If you have any suggestions on how may I improve my services we are here to listen and improve. thank you

Wagner - I have to be honest, to get you to respond to email has not been as easy or get you on call. When you do come like i stated above you offer all the support over email or call but words help so much! and you keep saying you don't make any commission again that does not help us. We have put our 20%  in my case for two properties and we lost it technically, so whoever makes or not does not help us. If you really can help, you should get a legal team for us and help us fight this battle together. On this forum i am just saying what I am going through with no bias so others don't undergo what me or other like me have gone through. I have spoken to multiple folks in my same state. 

Again, if I get help and this is resolved, trust me i will be here the very next day/hour and post it as well. We got to the builders through you and we obviously look to you to help us get off it with no financial loss.

Good morning Vinod,

As per your request i have located an attorney for you in florida and shared the contact on 03/31/2024 at 18:41. Im here to help as much as possible, im the broker of record for these transactions not the seller, i wish i had the power to return the deposits and cancel contracts( but only the seller is able to do that), once again  im only the broker. If you ever need me to depose or assist on anything we will always be here for you. I can always contact the seller and keep you updated( as i have done numerous times) but i do not control the properties or construction. 

I understand your frustration, but remember i will only collect any commissions once properties close and are delivered.All deposits were made directly to the seller not to me.  Your satisfaction is my goal, i have been servicing these contracts without any gains. My name, my reputation and my clients is all i have. 

I will continue to be here for you and all of my clients and i will continue to serve you to the best of my abilities.

What is the story here? It seems like Wagner is just a broker and the issue is with the builder who isn't performing?  I am trying to understand where the deposit money went? Did you all pay directly to the builder? Seems like a big mistake if that were the case. If the title company is holding the funds and the contract has been breached by delay can't you just get your deposit back?

Good morning Sebastian, I am just a broker. All deposits were deposited directly into the title company.

the Project experienced several delays and asper the builders information whomever wants to cancel the contract. They're offering the lot since you international builder to refund all deposits. Are you a buyer of this project as well? It'll be a pleasure to assist.

@Wagner Nolasco Thanks for confirming....Not sure why you are getting all of the heat and not the builder. Can nobody get in touch with the builder? Why don't these investors terminate and get their deposit money back?

Sebastian - let me give you more details so you are aware. The builder who took the 20% stopped responses and claimed he was bankrupt. 

Finally after a 2 year wait Wagner got in another builder as replacement who provided two plots as replacement. Apparently those two plots after a year we realize does not even belong to this new builder, so bottom line the money is as of now lost. The plots are in some other owner name. Am here just to let folks know of my experience so others are careful when they get into this. Better to buy a home that is ready to move is the learning I got from all this.

@Vinod Moorthy  Wagner said the deposits are held by a title company and you are saying the builder took the 20% deposits. Which is the case or are the remarks in this forum in relation to different housing projects and builders?

Hello Vinod and Sebastian. The builder that Vinod has a contract with is Elite builders( I never said that they were bankrupt) as I don't have this information from the builder nor the public records. Previously on the chat we were discussing about D32( different builder) you are correct it's a different builder. 

Due to confidentiality and professionalism I cant share clients information on this chat.

Bottom line is - we have all lost the deposit and have no idea how to get it back irrespective of who the builder is.  Trust me I am not alone here.

Wagner - I did not want to drag this any further  - you keep saying you are available for any help but again if you think we will come to you for any real estate help after bring in this situation for 3 years, you are missing the point :). Just to be there to respond to messages saying you are available does not help. Unless you can influence the builders to return our deposits like you made us get into this deal with them as we trusted you, the matter has not moved an inch for folks like me. I will rest my case here.

Vinod, Wagner already shared the deposits are were directed directly with the title company and not the builder. Did you authorize the release to the builder or is the title company still holding the deposits. There's no consistency to what is being shared.

Good morning,

I dont have all the details but as per my understanding the following occurred:

1, buyer and seller signed the purchase contract.

2, buyer made deposit as per the contract into escrow at sellers title company.

3,Im not sure if contract autorizes title company to release deposits to seller.

4, Builder seller encountered several delays on delivery of the house.

As the licensed transactional broker i have been trying to communicate and update buyer on all and any information i get in real time.

What other buyers have requested is a local legal council to assist them. I obtain good referrals of

All buyers from D32 and Elite Builders,

I have been the transactional broker of record for Bennah Oaks, Nathi and Elite builders.. All clients have been in constant communication with me and my team and we have brought  the most  current and up to date information provided by the builders. 

As per many buyers requests i have been introduced to an attorney:

He is able and willing to represent any buyers interested in retaining his services.  yesterday on a call with a forum member and a buyer he asked "wagner why the buyers don't have forums for the builders that are delayed on deliveries but they are crucifying you?"

I did not have an answer, i come to ask you please lets set forums for the builder and express your absolute correct and rightful frustration.

As the transactional broker im limited to what i can do. But i will continue to help, support and be here for all of our clients.

After all, which construction company received the money and is not fulfilling the contract? And what is the name of the Lawyer who is handling this situation on behalf of the buyers?
