We're in a similar situation. We just told our investors that they are accruing at 8% each year for the first 3 years but that they would need to accept 4% per year (towards the 8% yearly) for the safety of the property and everyone's funds. They still get some interest money for the first 3 years and they get everything that's owed/principal at the refinance

Would the SDIRA be subject to UBIT if they're used strictly as a loan? For example, we have a property under contract where the current owner will carry $850K out of a $975k property. The SDIRA will not own any shares of new LLC but will be used as a loan instead of a LP. Will this subject the SDIRA to UBIT?

We currently have a 20 unit apartment building under contract in Norfolk, VA. We're going to refinance out in ~3 years. Does anyone know how a bank comes up with the value of the building? Is it the same as when you're trying to sell it (NOI and cap rate) or do they factor in other things as well?
