1) Because new investors do not always have the ability to do the work to the property. They don't have the funds or credit to purchase and rehad the property to resale it. Or to buy and hold it. So for them they get to make some money and make an investor happy at the same time. That is why wholesaling ad bird dogging are popular among new REI, that have little or no cash to start making deals.

2) Don't really know about the wholesaling aspects of REO because I don't know of anyone that has been able to get a bank to sign an assignable contract. But using transactional funding to flip I have seen. However to answer the questions on why an investor might rely on someone else to find the deal and pay them for it.

Simple, they don't have time to do it themselves. They invest in many areas so for them to find and keep up with all of the REOs for sale in an area is impossible. Why not let someone else do the leg work.

Kind of like, you can return phone calls to the 200 people that left their name and number on your website, but isn't it easier to pay someone 8 bucks an hour for a week to do it so you could do things like find new properties, or new investors. Its all about leveraging your time.

I think it is advantageous to pull a gun on someone and steal the 1000 bucks they have in their wallet. Of course I'll make sure they understand that I am doing it because I feel it is advantageous and ethical to me, whether they like it or not.

Extreme example but still true your taking an advantageous action to yourself not the person you bought from. As sad many times, in this business your biggest asset is your name.

With the recent activity in the Gulf it may be hard to find HML that will lend for that area. I think a lot of investors are waiting for the "dust to settle" so to speak.

In some states there are mitigation of damages clauses that require you to attempt to find a replacement tenant for her since she moved. And if you cannot she could have a civil claim.

I don't know how that would play out if she agreed to continue to pay rent. However if that is not in writing then you have a problem.

My question to you would be, did she actually pay the 3 months of rent?

If so then you have to treat her deposit as any other deposit that is given from a tenant that fulfills their lease obligations.

Your best bet is to speak to an attorney about the situation. And to take the time to read the property code, that deals with landlord/tenant laws, and make sure you understand all of these laws.

A person can be put in for an emergency order of detention if it can be articulated that they are a danger to themselves or someone else. And they will be taken to a regular hospital emergency room. That being said. I have seen EOD's written for people who are drunk. I have even seen psychologist get them issued when they feel the person needs help but is not an immediate threat to themselves or others.

My favorites are, "their drunk they could walk out in front of a car therefore they are a danger to themselves and others".

Now these are only good for 72 hours in my state before a judge has to sign off on them, but hey if your locked up in the hospital and I can go to the judge and tell him some of the crazy crap you've done, he might issue a mental health warrant.

I know I have gotten off target. Simply put Tim your right there is more to this, and he should contact a lawyer immediately.
