But I'm willing to risk it most times and just assume the "reasonable" defense will keep that risk to a minimum.And 999 times out of 1,000, I don't see the tenant contesting occupancy at that point anyway.

The guy who has a drug possession charge from a few years back that he pled no contest to because he couldn't afford bail and needed to get out of jail to get back to his minimum wage job to support his kids, he has a good chance of being fine.

For instance the bankruptcy lawyer may contest the bank's right to foreclose, but I don't want to speculate about a specific situation because there are a lot of variables and unknowns.

But if a tenant defaults they have a right for due process to contest the eviction.We see people try and do this with having a borrower on seller finance sign the deed back over to the lender and if they miss a payment the lender can record the deed back into their name.
