Sure, you won on the issue (good for you) but recording never would have harmed you, and recording doesn’t alter the analysis of “subject to.”

They generally cannot terminate or alter the lease simply because they purchased the property, unless the lease itself includes a specific clause allowing termination upon sale.

That means your duplex wouldn’t qualify for the new 100% bonus depreciation, and you’d be subject to the 60% rate in effect for 2024 acquisitions.The only way around that would be if the construction contract was non-binding or significantly altered after January 19, 2025, which could, in theory, reset the acquisition date.

The one I find more concerning says:Interior alteration of enclosed covered entry converted to living space, main building encroaching set back on east elevation and attached structural storage/living space encroaching set back on north elevation.BTW, I thought I had included a link to the property on Redfin in this post.

Don't get me wrong there a ton's of other little things, but being able to go back to 2012-2013 and start pulling in $150K + a year as a fresh grad with little expenses would have substantially altered the trajectory of my life, but then again, who knows if I every would have found these forums...other than that most of my regrets are centered around not figuring out "myself" and how I work and interact with people sooner.
