So, I do agree with hedging your bets and serving a notice to pay or quit.The issue with them not paying rent and you using the security deposit is that they have zero incentive to clean the unit and if they damage it, you have no additional funds.If it were me, I'd serve them an eviction notice and then mark them as owing on a credit reporting site(I use Front Lobby).

Negotiating and making offers is the biggest weakness of so many agents but it's because their sales is weak.Not trying to sound negative, but it's amazing to me how many times I've talked with an agent and they'd say, "oh there's no good deals out here."

That mix of one vacant side and one leased side can definitely get messy with FHA’s owner-occupancy rules.If you need the place vacant to satisfy FHA, I’d keep it simple in the offer and just say something like:“Seller to deliver both units vacant at closing, and provide tenant notice within X days after due diligence ends.”That makes it clear what you need while still giving the seller a fair window to handle the notice properly.That said, since the other lease runs until next July, there’s a good chance the tenant won’t (and legally doesn’t have to) move early unless there’s some incentive.

Dropping rent slightly or adding a small incentive like flexible move-in dates can help keep momentum going without cutting too deeply into cash flow.Sounds like lowering rent a bit already made a difference, which is great.

If you find one, you can add the cost into rent or collect it as a flat monthly fee.Create a small, secure trash area - A fenced or enclosed spot near the top of the driveway can make things easier for tenants or haulers to manage.Consider small incentives for upkeep - I’ve seen owners give a small annual rent credit or gift card for tenants who consistently keep the exterior clean and manage trash properly.
