A lot of investors I know either use leases from their state apartment association or they get them through a good local property manager, since those are usually already updated to match local laws and save you from having to reinvent the wheel.

@Crystal Smith"Private lending" and "private finance transactions" come out of SEC requirements and not being subject to finance laws, if you're in the business of the activity, you're not a private lender, regardless of what a real estate attorney may think.

Now, the property is no longer in the borrower's name and the 1st can call the "due on sale", forcing the winning bidder to pay of the 1st or go to foreclosure himself.Remember, this is according to each states laws of payoff, so each state has a sequence and is state specific.
