The HOA documents (bylaws and declarations) spell out what the HOA and what the unit owners are responsible for (from an maintenance, Insurance, and ownership perspective).  

Once you know the owner(s) and condition of the title, whether the owner had a will, who Ohio law declares should inherit the property, and what the owner's family tree is, then you can answer  "... who would inherit the house?" 

In Alabama, your primary residence has a discounted rate via the homestead declaration.

There is likely a provision in the Declaration that permits them to allow/deny transfers of title, but that same provision should have some form of parameters for which they can deny a transfer of title.
