Your original post is enough evidence for them to get a court order to take properties you buy in the future.It sure took a while but somebody finally raised an important issue.Months ago, all national title insurance underwriters issued bulletins regarding the marijuana issue.Long story short, nobody is insuring any transactions where the subject property will be used, or will potentially be used, as a dispensary, growing facility, etc.

Don't take an 'unreasonable' amount, to avoid 'equitable interest' issues down the road.You can offer seller concessions to cover their closing costs in lieu of offering 'rent credits' which can be viewed as a 'financing agreement', and subject to lots of fun rules.Keep the lease completely independent of the option; don't tie performance of the lease to the performance of the option.

As many of you are well aware, I am no fan of RTO or LTO as I believe there are serious legal issues at both state and federal levels involving the concept of both of these being a form of a disguised credit transaction and that further individuals or organizations so engaged also fail to comply with other state and federal laws they are subject to.
