Did you know that as a homeowner you are suppose to have access to your HOA's financial records. The key word is "suppose" to. This right is documented in your by-laws and most likely in some State legislation. The fact is, if you want access it can be denied. It has been denied to many in Colorado and the Courts backed the HOA. Really, and how pathetic. Colorado Small Claims Courts, now riddled with lawyers due to a change in State law that allows their presence, and District Court have denied homeowners access to financial records in favor of ignoring HOA by laws and retaining the secrecy behind HOA Board operations. Yes, this places the homeowner at risk of financial corruption and HOA bankruptcy and other financial irregularities. Colorado state legislatures ignore the rights of homeowners in favor of the real estate, developer, and property management companies who have the funding to influence. So the next time some tells you about your homeowner rights stated in your HOA by laws, forget about iit.
