I was wondering if you live in one state would you be able to form a LLC in another state. I currently live in VA and I was trying to see if I could form a LLC in MD?

The reason is that in MD it's easier to form a LLC. In MD you don't have to go through a lawyer.

Any suggestions?

You will need to either form the LLC in the state where you're doing business (e.g., owning property), or form it in a different state and register it in the state where you're doing business as a "foreign company". Simplest is to forum the LLC in the state where you do business.

Absolutely. An LLC is easily formed in Maryland. The only issue you may run into is the requirement in most (if not all) states that you have a registered agent that maintains an office or residence in the state of formation. This is easy to take care of if you have a friend or family member that resides in Maryland and they allow you to list them as the registered agent. Their info will be listed in the Articles of Organization. Most, if not all, states require a registered agent in case they are needed to received any important documents, process servers, etc. Their are also tons of places found on the internet that will not only act as your registered agent, but will also file all of the paperwork for you. I live in Maryland and set up an LLC in Louisiana through an attorney. The attorney is the registered agent and also filed all of the paperwork for me. I have since acquired a property that is now listed as the domestic office of the LLC but am still using the attorney as the registered agent since the attorney maintains a permanent presence and I am only in New Orleans part-time. It only ran me about $250. Hope this helps.

FYI, you can expedite the application and have the LLC formed the same day in Maryland but it will require a trip to Baltimore (Preston St., I believe). You can complete your Articles and take it to the office, pay the fee and the fee to expedite, and, within a few hours, have everything set up. I did this when I incorporated another company. I know it can be several weeks if you apply by mail and if there are any questions or issues, it can add significant time through the mail.
