i have a tennant under lease...she moved out of state...she has her son living there and they are not paying rent...they also have the gas shut off...Do I have to treat this like a normal eviction, or since the son is not on the lease and the gas is turned off can I do an immediate eviction...if it helps Im in Bufalo Ny;Thanks...Joe

In some jurisdictions, the Sherriff's office will actually escort you to do an eviction as well...

As for her son's "bike gang".....haha....get proof that she threatened you somehow....and throw her scrum trash a$$ in jail.......

Evict this woman ASAP. Keep very detailed notes of all of the conversations that you have with her.

In the future if she has not paid by the 5th (or whatever date your state allows) start eviction then.

just got off the phone w/her...she said if I evict her son she has a motorcycle gang looking for me...and quote "ill be sorry"

And don't forget to get a judgment against her so that she is on the hook not only for back rent but for all the legal fees as well.  Collecting may be difficult but it sure will wreak havoc with her credit if she cares.

Letting your tenants intimidate you is a sure path to financial ruin and non-stop headaches.  You're property - you call the shots.  Period.

NC is a 'one party' state meaning I can record my phone conversations.  Don't know the law in NY but you might check.  Always nice to have a record of someone's threats.

Did you say _she_ has a motorcycle gang?  Look, if she could reach out to you she wouldn't do it over the phone.  Same with her son.

What is the difference between her son, who is not on the lease, and a homeless person, who is not on the lease?

Her son is trespassing.  Period.

Get an attorney and evict him yesterday.
