How exactly does one check? When we hired a licensed contractor for some painting in one of our rentals, we stopped by only to find there were about 3 or 4 hispanics doing the painting, not the "white" guy we hired. These laborers may have been citizens, legal residents... or not. What do you think would have been the answer had we asked them - or the contractor?
That's the biggest problem with this illegal immigration work issue... verification. Sure, if you have a company that employs people, there is a (flawed) system in place to help check employment eligibility, but what does somebody hiring a laborer as an independent contractor for a couple of hours do?
Are there that many illegal immigrants in South Dakota? Never been... but seems like those would be some darn persistent and easy to spot illegals, would it not?
This issue is a lot more prevalent here in Southern California. I'm proud to say every contractor I've ever worked with has been a US citizen, and I know that nobody can prove me wrong. Nor would anyone really have much incentive to.
The problem is so bad in some parts of Califonia you could drive for miles and not see a white guy and on top of that Mexico flags flying at many businesses and homes!
I moved from my cozy Danville home to this place to invest in rentals for a few years then hire a property manager and go back home. I live in a nice area in my temporary home but the towns overall population is 87% Hispanic and many of them do not speak English!
Rule number one should be if you want to live here you must read, write and speak English, anyone pulled over that fails a simple test gets sent back to where they came from.
Jake-of course there are illegals in South Dakota. You need look no further than the meat-packing industry in any state to find them.

Many illegals use fake or stolen SS numbers and require further investigation. My ex wife is a Mexican American born here and raised by parents that immigrated here the legal way. She was not even tought Spanish because they wanted their children to be "real Americans". These highly educated Mexican Americans are far more prejudice towards illegals than any white person.

I don't go out of my way to hire illegals but I do not check SSN's. I wouldn't get anything done if I required full background checks on all the brown skinned people that work for me.
On of the local cities tried to pass a law that landlords had to verify the legal status of all prospective tenants. Law failed to pass, landlords should not have to do the governments job.
The city then decided all prospective tenants had to get an application permit from the city. The permit was so the city could ensure legal status. Not sure what happened to the resolution after that but I do know the vacancy rates in that area are rapidly rising.

Well, that's kind of an indictment against our public school system. Maybe that is why there are a lot of "idiots who can read or write english". But I thought we were talking about hiring people who are here illegally.
Kind of silly suggestion. I think a person's legal status is more relevant to whether they should stay, rather than their literacy level. Duh?

When someone doesn't understand Chemistry or Physics or Geometry, we can blame the school system.
But, when someone chooses not to master the ability to read, write and speak their native language, that's pure laziness on the part of that person.

I don't think a judge would amused if I took that line of reasoning if I ever got taken to court for hiring illegals. It's illegal to hire illegals.
So who cares if a rehab laborer can write a coherent paragraph or know chemistry, anyway I'd be more concerned in their work habits and whether or not I will get fined heavily for hiring them due to immigration status.
My friend was illegal and he was employed in AZ by a carport repair dude. I never thought anything of it and didn't see people lining up for a $10/hr labor gig. I'll have to ask him about the SSN thing. Oh and by the way he was white as can be and loved his edmonton oilers. He did speak english, but in that funny canadian way. I should have reported his ass to ICE.
What I've never been able to understand is why any free market capitalist would not be behind some form of immigrant work visa. Better yet, let's mandate that all work done on Fannie or Freddie REOs be done by union labor and have at least one full time OSHA officer on site.
Any one ever been through Solvang, California? Its an quaint little town in the heart of the central coast wine country that was originally settle by the Danes. There they fly Danish flags from their businesses and homes! Some of them even have the audacity to speak Danish.
I don't see any reason to check ID for independent contractors. They are responsible for their own taxes and issues. Personally, I'd rather an illegal work than sit at home and collect benefits.
I think the government should make it easier for those wanting to work to immigrate to the US. Most of these people aren't taking jobs Americans are willing to do anyway.
Oh, and one of my Hispanic workers was injured a couple weeks ago. I did not know this until today. He's a sub of a sub. He was working today to pay back his $20,000 hospital bill that your taxes won't be paying for because he actually gets off his ass and goes to work. I have more respect for him, legal or not, than most of my old tenants.

Regardless, as I've stated in dozens of posts and several BP Blog articles, I would never hire any contractor without having them fill out a W9 and provide proof of insurance.
I'm fairly certain that if you do that, you'll be covered, even if someone provides bogus documentation or if a contractor hires an illegal sub. From a practical standpoint, I can't imagine most judges would hold a small business owner accountable for that type of situation where reasonable steps were taken to protect the business owner from liability.
