Suing a borrower for breaching contract

Hello fellow BP bloggers,

Has anyone had experience or know of any cases where you sue a borrower who is not willing to pay you back the personal loan you made?  It's a personal loan with a signed promissory note secured by deed of trust along with signed personal guaranty.  Only thing is that recorded deed of trust is in default by the first (i am third) and can no longer be used as a good collateral.  Was wondering if anyone had experience in this type of situation or know any attorney that would be willing to help out on commission base.  Per the personal guaranty the borrower would need to pay for the attorney fee, but also the pay back amount (principle + interest) would easily cover any attorney and legal costs.

Any help on this matter would be appreciated.  Please message me.

Thank you!

D.
