Pit Bull Issue
I have a fairly new tenant that I just rented to one month ago and just found out recently that he has a pit bull. I confronted the tenant about the pit and said that my insurance will threaten to cancel my policy if we do not have the dog and or tenant removed. The tenant told me that he registered the dog with the city as a lab/terrior mix. I have no idea what action I should take in this situation. Should I ask for a copy of the dog registration paperwork to cover myself or is that still insufficient since the dog really is a pit bull? Any and all advice will be so greatly appreciated. I am extremely nervous about this.

Eric - So he admitted to you that he falsified docs with the city in order for the city to allow him to keep his dog?

There is a reason that the tenant did not let you know about the dog in advance, because you would have said no. I don't care what breed they call the dog, if it looks like an attack breed it's gone. I don't see that registering it with the city will shield you or your insurance company from any liability. I agree, the dog goes or the tenant goes with the dog. Good luck.

I actually ran into a similar issue last month. I was buying a "turn-key" property with a tenant in place, yet there was a pitbull in place as well. I called my insurance provider and they would not insure me for the dog, so I told them to get rid of the dog or we would have them vacate the property. The lease did specify no pets, so it was not too big of a hassle. They ended up giving the dog to a relative, but I still have my prop mgr drive by to check and he has given his phone # to the neighbors to ensure there is no re-appearance of the dog.

issue notice to perform and either the tenant gets rid of dog or you get rid of tenant Also most leases I have seen say no pets so regardless of Terrier or Pit you likely have cause
