Missouri Investors: Take Action

Don't Let Missouri Landlords get caught between Rental Licensing Inspections and Tenant's 4th Amendment Rights

Many cities across the state of Missouri are creating rental licensing laws that require an interior inspection of the rental property to obtain the license. This inspection by the city or county inspector, without a warrant, is a violation of the tenants 4th Amendment Rights and in some cities have been struck down as unconstitutional and in some cases requiring restitution be paid. HB 1510 would give the tenant the right to refuse such city or county inspections without worry of reprisal from the city or county or the Landlord. In some cities, the landlords are being told that if the tenant will not allow city inspectors in, that the landlord has to force their way in or evict the tenant for refusing the city or county inspection. With HB 1510, the cities and counties can still have their inspection laws, but in the case of inspections tied to rental licensing, the tenant would be able to refuse this inspection and the city or county would have to get a warrant to inspect.

This bill may not stop the cities rental licensing and interior inspection programs, but we hope it will slow them down and not put the landlord in the position of having to let city inspectors into tenants homes and assisting the city and county in violating 4th Amendment Rights. Changing the Law is way cheaper than a suing the city.
