The Benefits of the O-1 Visa
While there is no shortage of nonimmigrant business visasto choose from, the O-1 Visa is especially well-suited for actors and models for several key reasons.

  • Geared Specifically to Talented Individuals. The O-1 Visa is explicitly designed for “individuals with extraordinary ability or achievement” in the arts, cinema, television, fashion, athletics, and more. Thus, it is relatively easier to qualify for than other visas that may not support the different criteria that apply to actors, models, and other creative or artistic professionals.
  • No Degree Needed. Unlike other visas, which require certain degrees or certificates, the O-1 Visa’s primary requirements is that you prove your achievements in acting or modeling — regardless of whether you have a degree.
  • No Maximum Stay. O-1 Visa holders can be granted an initial stay of up to three years, with an indefinite number of one-year extensions for as long as necessary to complete their job.
  • No Need to Line Up Jobs in Advance. While many visas are contingent on candidates having a job secured prior to applying, the O-1 Visa can be obtained without formal employment.
  • You Can Bring Family. Spouses and children under 21 can obtain the O-3 Visa to join the O-1 Visa holder for the duration of their stay.

Qualifying for the O-1 Visa
In addition to filing out Form I-129, Petition for Nonimmigrant Worker, you will need to submit various documentary evidence proving that you are exceptionally talented or esteemed in the acting or modeling community. This evidence includes receiving or being nominated for a significant national or international award in your field, or at least three of the following:

  • Received national or international recognition for achievements, as demonstrated by published materials by or about the applicant in major newspapers, trade journals, magazines, or other prominent publications
  • Played or will play a starring role in productions or projects that are distinguished, as shown by critical reviews, press releases, publications, or prominent endorsements.
  • Involved in organizations that are esteemed in the acting or modeling industry, as evidenced by trade journals, testimonials, or other prominent publications.
  • An established record of critical or commercial successes within their area, as shown by critical reviews or ratings, appearances in prominent trade publications, major reports, and so on.
  • Written recognition from relevant organizations or experts in the applicant’s field indicating their achievements.
  • A high salary or other substantial compensation for acting or modeling work compared to others in the field, as demonstrated by contracts or financial statements.
