Husband and wife have community property in California, the land lot value under $10k, wife is disabled and now living in a nursing home. The husband does not have the power of attorney. Is he able to sell this land lot by himself?

Go through the steps
1. Is she still mentally cognizant? Then have her sign a power of attorney
2. Unless your related to them or a friend it’s only a $10,000 sales deal. Walk away from it, irregardless of the answer to your question. You have bigger fish to fry
3. Are they paying for the care facility or state federal? If state federal she can’t have more than $2,000 of value. She has to sell and the funds go to the state unless it is a home. point is it has to sell either through her, him or a court order if she doesn’t do a power of attorney or is not cognizant.
