It depends on your lease. In PA a tenant can waive the right to notice if the clause is included in their lease. However, this is an anecdotal "friend of a friend" scenario, but I was told of a judge that threw out a case because "no one would knowing waive their right to notice if they knew what that meant". Some judges follow precedent and some judges like to practice law from the bench. After that I began to provide 3 day notices even though I keep the waive right to notice in my lease. I figure I keep myself safe with the argument "I didn't need to provide notice as they waived that right, however, the good guy that I am I still provided a 3 day notice to the tenant".
