Hello
I have a situation where my tenant is not paying rent after lease expired and saying that he will evacuate the house in next few days but there are no sign of him leaving.
What is the best strategy for me at this moment?This is a single family home in Elmhurst IL.

Right now, seriously, right this very minute - issue that free loader a Notice To Quit Due To Non-Payment of Rent. Since you're out of state, email it to him and let him know that the eviction process has commenced and then send it by certified mail with proof of delivery requested just to seal the deal. (In Illinois, failure of tenant to vacate at termination of lease is a reason for eviction along with failure to pay or to pay on time). It's amazing how some people just need a little motivation in order to do the right thing...this - along with keeping his security deposit - should pretty much do it. You got his Syed...

As everyone has said notice to Quit today. Start eviction. If he does leave in a few days he pays rent everyday he is there and make any other deductions.

@Syed Hussain - Did you or your tenant opt not to extend the lease or did the lease extend automatically for another year or month-to-month? If your tenant is now a squatter then an unlawful detainer may be the appropriate filing in your state. Consult with your real estate attorney. If the lease extended for another month then your tenant owes you a rent payment.

Hi Syed, I'm sorry to hear that you're dealing with this and I know how frustrating that can be. A personal friend of mine actually just went through this process and I'm definitely in agreeance with what others have stated in regards to filing to evict. In fact, it sounds more and more like the tenant is now squatting so you'll need to take the appropriate steps. Once you've gotten to a point where you're now looking for another tenant, there are definitely some thorough tenant screening options out there to help you mitigate the risk of a similar situation happening again in the future. Hi Syed, it is a good idea to proceed with the full spectrum of screening (an option that lets you pull not only their credit score, but also a full breakdown of their credit history, and also includes a nationwide criminal background check, sex offender registry list, and eviction history check). The more information you have/can uncover during the due-diligence phase, the better a decision you'll be able to make as far as the next tenant you decide to move forward with. Again, I'm so sorry to hear you had to go through that process with this past tenant, but now that it is vacant definitely are some landlord software options that make this process easy and seamless for you.
