Do I need to send notice at end of lease for vacating?

Question

My tenants are moving out at the end of the 1yr lease, but this has been a verbal agreement.  Do I still need to send a notice 30 days prior?  If so, can it be via email?  Or does it have to be snail mail?  proof of delivery etc necessary as well?

The tenant should also supply you with a forwarding address in writing.  So you know where to send anything, ans so you know where their mail is to be forwarded.

There was another thread where the tenants stated they were moving out so home was marketed and new tenant was waiting to fill the vacancy. Old tenants changed their minds so now there is a predicament without the proper paper trail. Just to CYA why not put something in writing to make sure they do actually vacat the property?

I think Maryland law states if tenant does not provide forwarding address, the property address should be used, so probably acceptable but look in your local landlord/tenant rules and see.

What if the tenant refuses to provide a forwarding address and says to simply mail to the current address and rely on the USPS forwarding their mail?  Is that acceptable?

If they are moving out by their own choice, they should put everything in writing to you.  They don't necessarily need to give you a reason, but they do need to provide a date by which they will be out.  Furthermore, the final month's rent and any pro-rations beyond that need to be paid with a cashiers check or money order.  Don't take a personal check.

If you are not renewing the lease, then you need to provide them in writing with a statement of such.  State laws vary on the delivery method and amount of notice required.  For instance, in CA a landlord is required to give 60 days notice for leases under two years.  Delivery can be personal or by mail.  You could most likely check with the local housing authority and they should be able to provide you with a clear answer, and they probably have a boiler plate form you can use as well.  Same rules apply as above with regard to rent.
