If the buyer received a generic info packet, which contained a copy of TDS, and the buyer reviewed generic property info packet before signing the purchase agreement. On a later date, the buyer received TDS (not sure if it's the same as the one reviewed previously or not) after signing the purchase agreement.

It is frequently included in the listing and expected to be signed and returned with the offer. Most agents have that filled out by the seller with the listing agreement or at least very soon afterwards.
