I'm so frustrated! I've wasted SO much time trying to find if grace periods and late fees are regulated in the state of GA and have found no mention of either. I've read everything from the GA Handbook to O.C.G.A 44-7 with no luck. I'm hoping a member might know if Georgia requires grace periods, or regulates late fees. If so, would certainly appreciate it being shared so I can move on with my life! Thanks in advance!

75 dollars. If it’s in writing and you have a talked to them and it’s part of the lease you shouldn’t have any problem. I don’t understand the regulated part. You aren’t a lender. You’re a home owner. Obviously it’s not some crazy fee, because people have to agree to it. No you don’t have to give them any extra days. But that’s not going to work either right? I mean things happen. So I work my tenants because I expect them to work with me.

There isn’t any official regulation on this. But the courts don’t seem to care. For the most part, county magistrates will limit what they allow for late fees to 10% of the rent. They generally don’t allow daily late fees that exceed that, either. They don’t enforce any sort of minimum grace period, though. All of our leases have the rent due on the first, late fee of 10% if not paid by the 2nd. Judges never give is a hassle on that.
