Loan Mods Are Not Negotiable Instruments & Copies Are Admissible!

FYI, the Third District Court of Appeals ruled a Loan Modification is NOT a negoitable instrument, and a duplicate is admissible on July 5th, 2018. A duplicate of a loan modification was originally submitted and it was rejected. Only on appear did the appellate court rule its is not a negotiable instrument. A negotiable instrument is one that guarantees a payment of a specific amount of money. While the homeowner does agree to pay the modified amount, its interesting its not considered equal to the note. Its not the note, its an agreement to modify the note and you can't sell it on its own, only in conjunction with the original note.
