Bo Tully Subject to on a fix and flip
2 November 2025 | 3 replies
Bo, that’s a complex situation — when a trust has no active trustee and the bank steps in as successor, it can really complicate creative-finance structures like subject-to.From what I’ve seen, the biggest hurdle is title and consent: most title companies won’t insure a transfer until the bank legally conveys or forecloses, and the lender typically won’t approve a title transfer that keeps their note in place. Some investors will sometimes use short-term bridge capital (through escrow only) to secure control once title clears — essentially a timing solution rather than a workaround for lender consent.Definitely worth looping in a title company that’s handled estate or trust transfers under distress.

Franklyn Benjamin Taking over a property & trust?
22 October 2025 | 7 replies
Buying and selling a property in an inter-vivos, revocable trust is fine, so long as you have the trust reviewed by a competent attorney, and you understand exactly what you are getting. Here's a very basic explanation of the mechanics: when ready to close, the current trustee would resign.
Alex Johnson What financial planning / tax strategy services do I need and how much should I pay?
28 October 2025 | 9 replies
Who to hire / ballpark:• Real Estate savvy, Tax strategist/CPA for planning • Cost seg study (condo STR): fee depends on size/firm dependent• Estate plan (revocable trust package)• Hourly attorney (LLC/lease/risk)I would suggest start with a 60–90 min tax planning session to map the 12–24-mo plan, then loop in attorney and (if green-lit) cost seg.
